On s e v e r a l  o c c a s i o n s ，  US armed f o r c e s  have conducted o p e r a t i o n s  i n  a r e a s  claimed by  o t h e r  c o u n t r i e s  but a r e  i n t e r n a t i o n a l  waters ，  such a s  n a v a l  o p e r a t i o n s  i n  t h e  Gulf o f  S i d r a  i n   t h e  1 9 8 0 s .  Throughout t h e  y e a r s ，  US f o r c e s  have been performing "Freedom o f  N a v i g a t i o n "  

o p e r a t i o n s  i n  t h e  S t r a i t s  o f G i b r a l t a r ，  S t r a i t  ofHormuz ，  S t r a i t s  ofMalacca ，  and t h e  I n d o n e s i a n   Ar c h i p e l a g o ，  t h e  Black Sea under t h e  name ' S i l v e r  F o x ' ， 

In 2014 ，  China Youth D a i l y  c a l l e d  t h e  American program an i n f r i n g e m e n t  o f  C h i n a ' s  

" r i g h t s "  t o  " r e c l a i m "  t h e  South China 8ea and East China Sea ，  tow l a r g e  b o d i e s  o f  waters t h a t   a r e  c o n s i d e r e d  i n t e r n a t i o n a l  w a t e r s .

4 .  The c o a s t a l  S t a t e  may ，  where n e c e s s a r y ，  e s t a b l i s h  r e a s o n a b l e  s a f e t y  z o n e s   around such a r t i f i c i a l  i s l a n d s ，  i n s t a l l a t i o n s  and s t r u c t u r e s  i n  w  h i c h  i t   may  t a k e  a p p r o p r i a t e  measures t o  e n s u r e  t h e  s a f e t y  both o f  n a v i g a t i o n  and o f  t h e   a r t i 五 c i a li s l a n d s ，  i n s t a l l a t i o n s  and s t r u c t u r e s .  

5 .   The breadth o f  t h e  s a f e t y  z o n e s  s h a l l  be determined by t h e  c o a s t a l  S t a t e ，  t a k i n g  i n t q  a c c o u n t  a p p l i c a b l e  i n t e r n a t i o n a l  s t a n d a r d s .  Such zones s h a l l  be  d e s i g n e d  t o   e n s u r e  t h a t  they a r e   r e a s o n a b l y  r e l a t e d  t o   t h e   n a t u r e  and  f u n c t i o n  o f  t h e  a r t i 五 c i a li s l a n d s ，  i n s t a l l a t i o n s  o r  s t r u c t u r e s ，  and s h a l l  n o t   e x c e e d  a  d i s t a n c e  o f  500 metres around them ，  measured from each p o i n t  o f   t h e i r  o u t e r  edge ，  e x c e p t  a s  a u t h o r i z e d  by g e n e r a l l y  a c c e p t e d  i n t e r n a t i o n a l   s t a n d a r d s  or a s  recommended by t h e  competent i n t e r n a t i o n a l  o r g a n i z a t i o n .   Due n o t i c e  s h a l l  b e  g i v e n  o f  t h e  e x t e n t  o f  s a f e t y  z o n e s .  

6 .  A l l  s h i p s  must r e s p e c t  t h e s e  s a f e t y  z o n e s  and s h a l l  comply with g e n e r a l l y   a c c e p t e d  i n t e r n a t i o n a l  s t a n d a r d s  r e g a r d i n g  n a v i g a t i o n  i n  t h e   v i c i n i t y   o f   a r t i f i c i a l  i s l a n d s ，  i n s t a l l a t i o n s ，  s t r u c t u r e s  and s a f e t y  z o n e s .  

7 .  A r t i f i c i a l  i s l a n d s ，  i n s t a l l a t i o n s  and s t r u c t u r e s  and t h e  s a f e t y  zones around  them may not be e s t a b l i s h e d  where i n t e r f e r e n c e  may be caused t o  t h e  u s e  o f   r e c o g n i z e d  sea l a n e s  e s s e n t i a l  t o  i n t e r n a t i o n a l  n a v i g a t i o n .  

8 .   Ar t i f i c i a l  i s l a n d s ，  i n s t a l l a t i o n s  and s t r u c t u r e s  d o  n o t  p o s s e s s  t h e  s t a t u s  o f   i s l a n d s .  They have no t e r r i t o r i a l  s e a  o f t h e i r  own ，  a ) l d  t h e i r  p r e s e n c e  d o e s  n o t   a f f e c t  t h e  d e l i m i t a t i o n  o f  t h e  t e r r i t o r i a l  s e a ，  t h e  e x c l u s i v e  economic z o n e  o r   t h e  c o n t i n e n t a l  s h e l f .  

第 60 条

(排他的経済水域における人工島、施設及び構築物)

1.沿岸国は、排他的経済水域において、次のものを建設し並びにそれらの建設、

運用及び利用を許可し及び規制する排他的権利を有する

a  人工島

b  第 66 条に規定する目的その他の経済的な目的のための施設及び構築物 c  排他的経済水域における沿岸国の権利の行使を妨げ得る施設及び構築物

2. 沿岸国は、 1 に規定する人工島、施設及び構築物に対して、通関上、財政上、

保健上、安全上及び出入国管理上の法令に関する管轄権を含む排他的管轄権を 有する。

3.1 に規定する人工島、施設又は構築物の建設については、適当な通報を行わ なければならず、また、その存在について注意を喚起するための恒常的な措置 を維持しなければならない。放棄され又は利用されなくなった施設又は構築物 は、権限のある国際機関がその除去に関して定める一般的に受け入れられてい る国際的基準を考慮して、航行の安全を確保するために除去する。その除去に 当たっては、漁業、梅洋環境の保護並びに他の国の権利及び義務に対しても妥 当な考慮、を払う。完全に除去されなかった施設又は構築物の水深、位置及び規 模については、適当に公表する。

4. 沿岸国は、必要な場合には、 1 に規定する人工島、施設及び構築物の周囲に 適当な安全水域を設定することができるものとし、また、当該安全水域におい て、航行の安全並びに人工島、施設及び構築物の安全を確保するために適当な 措置をとることができる。

5. 沿岸国は、適用のある国際的基準を考慮、して安全水域の幅を決定する。安全 水域は、人工島、施設又は構築物の性質及び機能と合理的な関連を有するよう なものとし、また、その幅は、一般的に受け入れられている国際的基準によっ て承認され又は権限のある国際機関によって勧告される場合を除くほか、当該 人工島、施設又は構築物の外縁のいずれの点から測定した距離についても 600 メートルを超えるもので、あってはならない。安全水域の範囲に関しては、適当 な通報を行う。

6. すべての船舶は、 4 の安全水域を尊重しなければならず、また、人工島、施 設、構築物及び安全水域の近傍における航行に関して一般的に受け入れられて いる国際的基準を遵守する。

7. 人工島、施設及び構築物並びにそれらの周囲の安全水域は、国際航行に不可

欠な認められた航路帯の使用の妨げとなるような場所に設けてはならない。

8. 人工島、施設及び構築物は、島の地位を有しない。これらのものは、それ自 体の領海を有せず、また、その存在は、領海、排他的経済水域又は大陸棚の境 界画定に影響を及ぼすものではない。

1 .   An  i s l a n d  i s   a  n a t u r a l l y  formed a r e a  o f  land ，  surrounded by water ，  which  i s  above water a t  high t i d e .  

2 .   Except as p r o v i d e d  f o r  i n  paragraph 3 ，  t h e  t e r r i t o r i a l  s e a ，  the c o n t i g u o u s   zone ，  t h e  e x c l u s i v e  economic z o n e  and t h e  c o n t i n e n t a l  s h e l f  o f  an i s l a n d  a r e   determined i n  a c c o r d a n c e  with t h e  p r o v i s i o n s  o f  t h i s  Convention a p p l i c a b l e   t o  o t h e r  land t e r r i t o r y .  

3 .   Rocks which cannot s u s t a i n  human h a b i t a t i o n  o r  economic l i f e   o f  t h e i r   own s h a l l  have no e x c l u s i v e  economic z o n e  o r  c o n t i n e n t a l  s h e l f .  

第 121 条(島の制度)

1.島とは、自然に形成された陸地で、あって、水に固まれ、満潮時においても水 面上にあるものをいう。

2.3 に定める場合を除くほか、島の領海、接続水域、排他的経済水域及び大陸 棚は、他の領土に適用されるこの条約の規定に従って決定される。

3 . 人間の居住又は独自の経済的生活を維持することのできない岩は、排他的経 済水域又は大陸棚を有しない。

4  。
