「まなビューア」使用許諾書

「まなビューア」(以下「本ビューア」という)を使用する際には，次の「ソフトウェアのご使

用条件」の全ての条項に同意する必要があります。本ビューアを利用された方は，下記，

「ソフ

トウェアのご使用条件」の各条項に同意したものとみなされます。本「ソフトウェアのご使用条

件」をご確認，ご理解頂いた上で本ビューアを使用してください。

ソフトウェアのご使用条件

１．使用許諾

(1) 光村図書出版株式会社 (以下「当社」といいます)は，お客様が本文に同意し，これ

を遵守することを条件として，お客様に対し本ビューアの日本国内における譲渡不能・

無償の非独占的使用権を許諾します。なお，次項に示すオープンソースソフトウェアを

除き、本ビューアに関する一切の知的財産権および所有権は当社に帰属します。

(2) 本ビューアは、別表に示すオープンソースソフトウェアを含んでいます。別表記載

のオープンソースソフトウェアの使用条件はそれぞれの適用ライセンスに従います。

２．禁止事項

(1) お客様は，本ビューアの全部若しくは一部を逆アセンブル又は逆コンパイルするこ

ともさせることもできません。

(2) お客様は，本ビューアの全部若しくは一部を改変し，又は他のプログラムと結合す

ることもさせることもできません。

(3) お客様は，本ビューアを固定している記録媒体を廃棄する場合には、固定された本

ビューアをあらかじめ復元不可能な状態に消去、削除その他の消滅の措置を必ず講ずる

ものとします。

３．利用者情報の取扱い

お客様が本ビューアを使用するに当たり当社が取得する利用者情報はありません。

４．当社の免責

当社は、本ビューアを現状有姿のままお客様に提供するものとし、明示又は黙示を問わ

ず、一切の法律上のいかなる保証も提供しないものとします。また、当社は、本ビュー

アに関し、お客様に生じたいかなる損害、損失、請求その他の責任についても一切の責

任を負わないものとします。

なお、お客様が本「ソフトウェアのご使用条件」に違反し、当社に損害が生じた場合は、

お客様は一切の賠償責任を負うものとします。

５．輸出等の処置

お客様が本ビューアの全部若しくは一部を単独で、又は、他の製品と組み合せ、若しく

は他の製品の一部として、直接又は間接に輸出すること、国外に持ち出すこと、国内非

2 居住者に提供し、または、使用させるなどの取扱いをする場合は、お客様は「外国為替

及び外国貿易法」の規制及び米国輸出管理規則等外国の輸出関連法規を確認の上、必要

な手続きをとるものとします。

６．解除

(1) お客様が本「ソフトウェアのご使用条件」に違反した場合，当社は本「ソフトウェ

アのご使用条件」に基づく許諾を解除し，お客様の本ビューアの使用を終了させること

ができます。この場合、お客様は、本ビューアを破棄または消去するものとします。

(2) お客様は、本ビューアを廃棄または消去することにより本「ソフトウェアのご使用

条件」を終了させることができるものとします。

７. 暴力団等の排除

(1)お客様は、現時点及び将来にわたって、自己が次の各号のいずれにも該当しないこと

を表明し、又は確約するものとします。

①暴力団、暴力団員、暴力団準構成員、暴力団関係企業、総会屋、社会運動等標ぼう

ゴロ、特殊知能暴力集団その他これらに準ずる者（以下総称して「反社会的勢力」

といいます。）であること、又は反社会的勢力であったこと。

②反社会的勢力が経営を支配していること。

③代表者、責任者又は経営に実質的に関与している者が反社会的勢力であること。

④自己又は第三者の不正の利益を図る目的をもってするなど反社会的勢力を利用し

ていると認められる関係を有すること。

⑤反社会的勢力に対して資金等を提供し、又は便宜を図るなど反社会的勢力に利益を

供与していると認められる関係を有すること。

⑥反社会的勢力と密接に交際をするなど社会的に非難されるべき関係を有すること。

⑦暴力的又は法的な責任を超えた不当な要求行為を行うこと。

⑧取引に関して脅迫的な言動をし、又は暴力を用いる行為を行うこと。

⑨風説を流布し、又は偽計若しくは威力を用いて、相手方の信用を毀損し、又は相手

方の業務を妨害する行為を行うこと。

(2)お客様が前項の表明又は確約のいずれかに違反した場合、当社は通知その他の手続を

要しないで、本「ソフトウェアのご使用条件」に基づく許諾の全部又は一部を解除す

ることができ、解除により生じた損害の賠償をお客様に請求できるものとします。ま

た、係る解除によりお客様に生じた損害について、当社は賠償義務を負わないものと

します。

８．準拠法及び管轄裁判所

本「ソフトウェアのご使用条件」は日本法に準拠するものとし、本「ソフトウェアのご

使用条件」に関する一切の紛争については，東京地方裁判所のみを管轄裁判所として処

理するものとします。

知的財産であり、現状のままで提供するものです。また、無償での使用許諾であり、当社

及び当該オープンソースソフトウェアの権利を有する第三者は、当該オープンソースソフ

トウェア及びその使用または使用不能に関して生じたいかなる損害についても、一切の責

任を負わないものとします。
