Damit s o l l  auch d a s  S t r a f r e c h t   d e r  s o z i a l i s t i s c h e n  Sache u n t e r g e o r d n e t  w e r d e n .  U m   e s  g l e i c h  vorweg zu nehmen: An  d i e s e r   A u s g a n g s p o s i t i o n  h a t  s i c h  g r u n d s a t z l i c h  auch nach d e r  Reform d e s  S t r a f r e c h t s  von 1997  n i c h t s   g e a n d e r t .   Was  s i c h   i n   d i e s e r   H i n s i c h t   a l l e i n   g e a n d e r t   h a t ,   i s t ,   < l a s s   s o l c h e   programmatischen Aussagen i n  L e h r b ‑ U c h e r n  zum S t r a f r e c h t  immer k i i r z e r  g e f a s s t  werden  o d e r  g a r  n i c h t  mehr zu f i n d e n  s i n d .  

2 .   Entwicklung des Strafrechts 

Nach Ausrufung d e r  V o l k s r e p u b l i k  am 1 .   Oktober  1949 wurden d i e   b u r g e r l i c h e n   G e s e t z e  d e r  , , R e p u b l i k  China" k o m p l e t t  a n n u l l i e r t .  Nur f u r  e i n z e l n e  B e r e i c h e ,  wie d i e  s o   g e n a n n t e  K o n t e r r e v o l u t i o n   (反革命罪） und K o r r u p t i o n ,  wurden Anfang d e r   5 0 e r  J a h r e   Regelungen e r l a s s e n .  Bemuhungen um  e i n e  K o d i f i z i e r u n g  d e s  S t r a f r e c h t e s  h a t t e n  nach d e r   e n t g l e i s t e n  s o  genannten Hundert‑Blumen‑Bewegung  (双百方針） und dem e b e n f a l l s  f a t a l e n   , , G r o f 3 e n  Sprung nach vom"  (大妖逃） k e i n e n  E r f o l g .  MitAusbruch d e r  , , G r o f 3 e n  P r o l e t a r i s c h e n   K u l t u r r e v o l u t i o n "   (尤戸附級文化大革命） war s e l b s t  d i e  V e r f a s s u n g  von 1954 d a s  P a p i e r

n i c h t  mehr w e r t ,   a u f  dem s i e   g e s c h r i e b e n  s t a n d .   E r s t   n a c h  Maos Tod 1 9 7  6  und dem  W i e d e r e r s t a r k e n  d e r  F r a k t i o n  u n t e r  Deng X i a o p i n g  i n n e r h a l b  d e r  K o m m u n i s t i s c h e n  P a r t e i   C h i n a s  wurde dem R e c h t  w i e d e r  e i n e  b e d e u t e n d e  g e s e l l s c h a f t l i c h e  F u n k t i o n  z u e r k a n n t .  Das  e r s t e  S t r a f g e s e t z b u c h  wurde s o d a n n  r e c h t  s c h n e l l  am 1 .   J u l i   1 9 7 9  a u f  G r u n d l a g e  d e s  3 3 .   E n t w u r f s  von 1 9 6 3  zusammen m i t  d e r  e r s t e n  S t r a f p r o z e s s o r d n u n g  v e r a b s c h i e d e t .   B e i d e   G e s e t z e  t r a t e n  am 1 .   J a n u a r  1 9 8 0  i n  K r a f t .  B e r e i t s  e i n  J a h r  d a n a c h  b e g a n n  d e r  G e s e t z g e b e r   d a s   S t r a f r e c h t  z u  e r g a n z e n ,  indem e r   i n s g e s a m t  22 s t r a f r e c h t l i c h e   N e b e n g e s e t z e  e r l i e B .   Nachdem d i e   S t r a f p r o z e s s o r d n u n g   1 9 9 6   r e f o r m i e r t   w u r d e ,   wurde a u c h   d a s   m a t e r i e l l e   S t r a f r e c h t  e i n  J a h r  s p a t e r  e i n e r  N e u g e s t a l t u n g  u n t e r z o g e n .  B e g r t i n d e t  wurde d i e s  m i t  d e n   p o l i t i s c h e n ,   w i r t s c h a f t l i c h e n   und g e s e l l s c h a f t l i c h e n   V e r a n d e r u n g e n ,   d i e   C h i n a   i n   d e n   z u r t i c k l i e g e n d e n   1 7   J a h r e n   s e i t   V e r a b s c h i e d u n g   d e s   e r s t e n   S t r a f g e s e t z e s   d u r c h l a u f e n   h a b e . 6 )  

2 . 1 .  Q u a n t i t a t i v e  Anderungen im S t r a f g e s e t z  von 1997 

W i r f t  man e i n e n  e r s t e n ,   o b e r f l a c h l i c h e n  B l i c k  a u f  d i e  b e i d e n  S t r a f g e s e t z b t i c h e r  von  1 9 7 9  und 1 9 9 7 ,  s c h e i n t  e s  z a h l r e i c h e  Anderungen g e g e b e n  z u  h a b e n ,  v o r  a l l e m  b e z o g e n   a u f  d e n  B e s o n d e r e n  T e i l .  Aus d e n  u r s p r i l n g l i c h  1 0 3  P a r a g r a p h e n  im S t r a f g e s e t z  von 1 9 7 9   wurden im neuen S t r a f g e s e t z  3 5 0  P a r a g r a p h e n ,  a l s o   f a s t   d r e i e i n h a l b  s o  v i e l .   B e s o n d e r s   b e t r o f f e n   i s t   e t w a  d e r  A b s c h n i t t  t i b e r   d i e   W i r t s c h a f t s d e l i k t e ,   d e r   von  1 5   a u f  nun 9 2   P a r a g r a p h e n  a n s c h w o l l ,  d i e  d e n  S c h u t z  d e r  j e t z t  s o g .  s o z i a l i s t i s c h e n  M a r k t w i r t s c h a f t s o r d n u n g

Auf d e r  a n d e r e n  S e i t e  wurden d u r c h  d i e  Reform d e s  J a h r e s  1 9 9 7  d i e  m e i s t e n  b i s h e r i g e n   N e b e n g e s e t z e   i n s   S t r a f g e s e t z   t i b e r f u h r t .   1 5   E r g a n z u n g s b e s t i m m u n g e n   wurden  v o l l i g   a u f g e h o b e n .  W e i t e r e  v e r l o r e n  i h r e  W i r k s a m k e i t  b e g r e n z t  a u f  i h r e  s t r a f r e c h t l i c h e n  T e i l e .  E i n   w e i t e r e r  Grund f u r  d a s  A n s c h w e l l e n  d e s  S t r a f g e s e t z e s  von 1 9 9 7  l i e g t  i n  d e r  Aufnahme d e s   M i l i t a r s t r a f r e c h t s  m i t  z w e i  n e u e n  A b s c h n i t t e n . 7 )

Das S t r a f g e s e t z  von 1 9 9 7  h a t  d r e i  s t r a f r e c h t l i c h e  G r u n d s a t z e  a n  v o r d e r e r  S t e l l e  i n  d e n   G e s e t z e s t e x t  a u f genommen:

§5 MaB und S c h w e r e  d e r  K r i m i n a l s t r a f e  s o l l e n  s i c h  am k r i m i n e l l e n  Handeln d e s   k r i m i n e l l e n  E l e m e n t s  und a n  d e r  i h n  t r e f f e n d e n  s t r a f r e c h t l i c h e n  V e r a n t w o r t l i c h k e i t   o r i e n t i e r e n .  

Von d e n  d r e i  k o d i f i z i e r t e n  s t r a f r e c h t l i c h e n  G r u n d s a t z e n  h a t  d a s  G e s e t z l i c h k e i t s p r i n z i p   im I n ‑und A u s l a n d  s i c h e r l i c h  d i e  g r o B t e  B e a c h t u n g  g e f u n d e n .  Denn d i e  E i n f i i h r u n g  d e s   G e s e t z l i c h k e i t s p r i n z i p s  war v e r b u n d e n  m i t  d e r  A b s c h a f f u n g  d e r  s e i t  l a n g e m  zum T e i l  h e f t i g   k r i t i s i e r t e n  A n a l o g i e  gemaB§79 S t r G  a . s e l b s t  m i t  e i n e r  K r i m i n a l s t r a f e  b e l e g t  werden k o n n e n .  A l s  e i n z i g  m o g l i c h e  S a n k t i o n  d a f l i r   war d i e  G e l d s t r a f e  v o r g e s e h e n .  Neben den E i n h e i t e n  s o l l t e  d i e  s t r a f r e c h t l i c h e  V e r a n t w o r t u n g   d e r  f u r  d i e  Organe v e r a n t w o r t l i c h e n  und h a n d e l n d e n  n a t i i r l i c h e n  P e r s o n e n  b e s t e h e n  b l e i b e n .   Die S t r a f b a r k e i t  von E i n h e i t e n  e x i s t i e r t e  b e r e i t s  f u r  b e s t i m m t e  n e b e n s t r a f r e c h t l i c h e  G e b i e t e ,  1 4 )   wurde j e t z t  a b e r  a l l g e m e i n  e i n g e f l i h r t .  G l e i c h w o h l  m u s s t e n  S t r a f t a t b e s t a n d e  d e s  B e s o n d e r e n   T e i l s   d i e   S t r a f b a r k e i t   von  E i n h e i t e n   a u s d r i i c k l i c h   v o r s e h e n ,   d a m i t   e i n e   S t r a f b a r k e i t   angenommen werden k a n n . 1 5 )  

B e z i . i g l i c h  d e r  S a n k t i o n e n  gab e s  g e w i s s e  V e r a n d e r u n g e n  b e i  d e r  A u f s i c h t  (管制） und  e i n e  E r l e i c h t e r u n g  f u r  d i e  Umwandlung d e r  s o  g e n a n n t e n  T o d e s s t r a f e  a u f  Bewahrung i n   G e f a n g n i s s t r a f e n . 1 6 )   Im GroBen und Ganzen e r f u h r   d a s   S a n k t i o n e n r e c h t  j e d o c h  w e n i g e   V e r a n d e r u n g e n . 1 7 )  Die R e c h t s f o l g e n  d e s  B e s o n d e r e n  T e i l s   u m f a s s e n  i n   v i e l e n  B e r e i c h e n   j e d o c h  v e r s t a r k t   G e l d ‑und V e r m o g e n s s t r a f e n ,   e n t w e d e r  a l s   a l l e i n i g e   S t r a f a r t e n   o d e r  ‑ h a u f i g e r  ‑k u m u l a t i v  m i t  a n d e r e n  K r i m i n a l s t r a f e n .  D i e s  h a t t e  a l l e r d i n g s  k e i n e n  E i n f l u s s  a u f   i h r e  E i n s t u f u n g  a l s  N e b e n s t r a f e .  

Neben  z a h l r e i c h e n   Anderungen  im  D e t a i l   s i n d   noch  f o l g e n d e   Neuerungen  zu  n e n n e n :  

‑d e r  B e r e i c h  d e r  Notwehr wurde a u s g e w e i t e t . 1 8 )  

‑d i e  V o r s c h r i f t e n  zum R ‑ U c k f a l l  wurden v e r s c h a r f t ,  indem d i e  B e w a h r u n g s f r i s t  von  d r e i  a u f  f t i n f  J a h r e  v e r l a n g e r t  w u r d e . 1 9 )  

‑d i e  V o r s c h r i f t e n  z u r  S e l b s t a n z e i g e  (自首） und zum Erwerb von V e r d i e n s t e n  ( 立 功 ） wurden n a h e r  b e s t i m m t  und a u s g e w e i t e t . 2 0 )

Der e r s t e  A b s c h n i t t  d e s  B e s o n d e r e n  T e i l s ,  < l e s s e n  I n h a l t  im S t r a f g e s e t z  von 1 9 7 9  d i e   D e l i k t e  d e r  K o n t e r r e v o l u t i o n  w a r ,  e n t h i e l t  im S t r a f g e s e t z  von 1 9 9 7  d i e  n e u e  K a t e g o r i e  d e r   D e l i k t e  d e r  S c h a d i g u n g  d e r  s t a a t l i c h e n  S i c h e r h e i t .  A l s  G r t i n d e  f u r  d i e s e  Anderung wurden  g e n a n n t : 2 3 )  

‑Es g a b e  e i n e  Anderung d e r  p o l i t i s c h e n  P r i o r i t a t e n s e t z u n g ,  denn d a s  H a u p t a n l i e g e n   s e i  h e u t e  d i e  M o d e r n i s i e r u n g  d e s  Landes und n i c h t  r n e h r  d e r  K l a s s e n k a m p f ,

Dem  S t r a f r e c h t  w i r d  i n  China t r o t z  d e s  zunehmend w i c h t i g e r e n  W i r t s c h a f t s r e c h t s  immer  noch e i n e  enorm bedeutsame g e s e l l s c h a f t l i c h e  R o l l e  z u g e w i e s e n ,  d i e  im P r i n z i p  von e i n e r   umfassenden A b s i c h e r u n g  d e r  g e s a m t e n  R e c h t s o r d n u n g  a u s g e h t .   Es s o l l   G a r a n t  f u r   d i e   S t a b i l i t a t  d e r  p o l i t i s c h e n ,  w i r t s c h a f t l i c h e n  und g e s e l l s c h a f t l i c h e n  E n t w i c k l u n g  s e i n .  3 2 )   D i e s   mag a u f  d i e  t r a d i t i o n e l l  hohe Bedeutung d e s  S t r a f r e c h t s  i n  China z u r i i c k z u f l i h r e n  s e i n .  Dass  d i e  hohen Erwartungen i n  d a s  S t r a f r e c h t  zu e i n e r  U b e r f o r d e r u n g  s e i n e r  L e i s t u n g s f a h i g k e i t   f l i h r e n  k o n n t e n ,  w i r d  wohl d e r z e i t  i n  China noch n i c h t  a l s  p r o b l e m a t i s c h  e i n g e s c h a t z t .
