しかし植民の歴史を通じて，教育とくに初等教育を通じた学校教育が，先住民族の言語と文化を否定し，その衰退を促進してきたことも事実である。植民地政策における同化主義は第二次大戦後まで猛威を振るった。 ILO169 号条約の採択と前後して，各国で植民地主義と同化政策は否定されるようになり，先住民族の権利保護とアイデンティティーの尊重，文化と言語の復興の取組みが広く行なわれるようになった。このような流れのなかで，教育は先住民族の最も配慮すべき事項，権利のうち言語と文化の二つまでも担うことのできる優れた手段として重要視されることになった。本稿では，先住民族の教育において ILO169 号条約が果たしている機能を，各国の具体的な施策を推進するための法制度の分析を踏まえて検討している。同化政策に対する反省は，非正規の教育を通じた先住民族の文化と言語の回復，権利保護の実践として積み重ねられてきた。ILO169 号条約と関連する国際法規，国際文書は，各国の先住民族に対する権利保護施策を担う法制度の大きな拠所となっている。一方で，我が国の取組みは本稿の 7．で詳述してある通り，世界の一般的な状況とは，かなり異なった様相を呈している。我が国の先住民族に対する施策において教育や権利といった事柄に言及があるのは，平成も 20 年代に入ってからのことである。教育は一般国民の先住民族に対する理解を促進する手段という位置づけにとどまっており，積極的に先住民族の権利保護を実現する機能を果たすまでには至っていない。注
