Abstract
When minors or mentally unsound adults committed wrongful acts which caused harm to others, are their guardians, who were either designated by statues or appointed by courts or by agreements, vicariously liable for these acts? If yes, under which conditions? This article focus on the concept of ''guardianship'' of the guardian liability under Tai-wan's tortious liability law. It tries to draw a general picture on current legislative, judicial and doctrinal issues. Facing futur challenges, it also suggests some possible solutions.
要 旨 未成熟の未成年者あるいは知的能力に欠陥がある成年者が、不法に他人に損害を加 えた場合に、法の規定または契約に基づいてこの行為者について監督権限をもつ者 (監督権者)は、如何なる条件で侵害行為について損害賠償責任を負うのか。 本論文は、「法定代理関係」(監督関係)を中心として、台湾の立法、実務および学 説の現状を紹介し、未解決な問題点について可能な解決策を提出する。 関連論文①
