1 have the‑honor to transmit to you herewith copy of a letter from Messrs Ald and co relative to a 

.‑claim against a Higo officer named Toyama Ichiya and a merchant named Fukudaya Kigoro amounting 

Rios 564760 for nonfulfilment of contract with regard to suppling them with Higo Tobacco. 

1 forward the contract (in original) by which you will perceive that it appears to be in perfect order

A1t. and Co as fol1ows.namely.That they wi11 deliver to Messrs Alt and CO at Nagasaki

Fifteen hundred picuIs (pcls 1500) of Higo Tobacco commencing to deliver about the middle ot the eighth Japanese 

month (29th Sept.) and completing the delivery by the end ot the ninth Japanese month (12th Nov.) 

The Tobacco is to be of the same quality as the three samples given to Messn~ Alt and Co namely Seven hundred (700) piculs of the best quality 

<Five hundred (500) piculs of the second qua1ity and 

Three hundred (300). piculs of the third qua1ity The whole of the tabacco must be sound

worse than the samples shown a proportionate difference is to be made in the price 

The price of the best quality is to be Seven Rios and two boos (Ro 7.2) pr. pcl 

The price of the second quality is to be Six Rios and one boo (Ro 6.1) pr. pcl 

The pr)ce of the thlrd quality is to be Six Rios (6.0) pr. pc1 

and the payment may be made either in niboo kin or in dollars at the rate of the day. 

Rio three thousand (Ro 3， 000) is to be paid in advance upon the signing of this contract. the contract 

itseIf being a receipt for the amount

and the remainder of the Tobacco is to be paid for as follows. The 

first three. thousand Rios worth of tobacco is to be paid for in full when delivered

1 have the honor ‑to acknowledge receipt of your communication of the 13th instant upon the subject 

of Messrs A1t & Cos claim against Toyama Ichiya and another man belonging to the Kumamoto Ken" 

and 1 am pleased to see that you have again sent to Kumamoto urging upon them the necessity of 

coming to a speedy dedsion. 

However this affair has now been pending such a long time that Messrs Alt & Co are getting very 

impatient. and wish immediate steps to be taken against Ora Kei to recover the amount due， as you 

will obse~ve by a copy of their letter addressed to me which 1 herewith enclose. 

Ihave therefore to request that you will have the goodness to give the necessary instructions to this. carried into ‑effect

， 

as their claim is a just .one.

"¥Ve beg to acknowledge receipt of the copy of a despatch from Mr. Miagawa Fusayuki

， 

Governor of 

Nagasaki， referring to our claim on the merchant Ora Kei. We notice that the governor lays great stress on the fact that Toyama lchiya is stilI being examined 

by the Kumamoto Ken， we would however again remark that we entirely look to Ora Kei for payment 

of our claim

， 

as the money was advanced by us solely on her security which we fully explained to her 

at the time the contract was signed. 

We shall therefore feel much obliged if you wil1 kindly urge the Gon Rei to take immediate steps. 

to obtain the money from the security Ora Kei is possessed of valuable property in Nagasaki

， 

and we 

would suggest that the same be immediately attached and sold to satisfy our claim of Rios 564760 with 

interest at 2 % per month from the 12th Novem ber last. 

In a claim. of ours long pending in your Consulate against some Satsuma officers， some goods held 

by them at the time our suit was instituted， were afterwardspledged to the detriment of our interests 

and it is to prevent the possibility of any similar action being taken by the security in the present case，. 

that we are so urgent for a early settlement

御手紙致啓上候然は去辛未年六月貴国人ヲ1ルト商社え旧熊本藩遠山一也福田喜五郎当県下商犬浦けい寅商法特約

いたし前渡金三千両受取候末約定期限を超候而も商法不相遂寛ニ同商社より及出訴候顛末御駈合ニ付一也菩五郎呼

越しけい一同及礼弾候処一也義廉々不将之所行及白状侠ニ付監倉入申付置候儀ニ而喜五郎ハ津崎庄次郎之代人ニも

無之一也頁商法之後は克ニ不存旨申立候依而一也は至当の刑典ニ可差行けいハ不普之義ニ連若いたし侠上は前渡金

三千両並約定之過料三千両ともオールト商社え償方市付候処当時廉々莫大之借金有之必至と困窮罷在何分一時解金

之運ひ付兼候ニ付先般一也より取立同商社え相渡置侯金三百五拾式両四合之外今般千三百九拾七両六合差出し都合

千七百五拾両を当金とし不足金千式百五拾両之令は来ル十月七十二年第十一月より始式拾ヶ月一三割合毎一ヶ月末金

六拾弐両式令宛無相違返済可致旨申出就而は約書中之過料金三千両は前陳詐欺ニ遇ひ難渋之事情景察棄憐一二視り度

段申立候ニ付右之情態御了解オ1ルト社中え御懇諭有之度けい申出之通同商社ニ烏ゐて承諾いたし候ハ︑当金之介

は至急取立貴下ニ贈達可致月割返金之儀は此末違約不実之俵無之様けい上り証書為差入万相怠り侠節は相当之取計
