COMPLAINT TO QUIET TITLE

COMES NOW the Plaintiff, ROYAL BLISS LINENS, LLC, a Florida limited liability company (hereinafter the “Plaintiff”) by and through its undersigned counsel, and files this Complaint to Quiet Title against Defendant THOMAS R. DULL (“Defendant”), and whomever having or claiming to have any right, title or interest in, or possession of, the following described lands in Orange County, Florida, to wit:

LOT 104, BLOCK 2, CAPE\ ORLANDO ESTATES UNIT 3A, ACCORDING TO THE PLAT THEREOF RECORD-ED IN PLAT BOOK 3, PAG-ES 101 AND 102, PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA. Parcel ID #: 24-23-32-1165-21-040 Property Address: 0 Ralston Street, Orlando, FL 32833

and would state and allege as follows:

1. Jurisdiction of the Court. This is an action to quiet title and ejectment to certain real property situated in Orange County, Florida filed pursuant to Section 65.021, 65.031, 65.061 and 65.081, Florida Statutes. Alternatively, in the event that Plaintiff’s tax deed title is determined invalid as to Defendants this is also an action to foreclose a statutory lien for such invalidated tax deed pursuant to the provisions of Section 197.602, Florida Statutes.

2. Deraignment of Plaintiff’s Title. At the time of the commencement of this suit the Plaintiff is in possession of, and is the owner in fee simple of, the following described land in Orange County, Florida (“Property”), to wit:

LOT 104, BLOCK 2, CAPE\ ORLANDO ESTATES UNIT 3A, ACCORDING TO THE PLAT THEREOF RECORD-ED IN PLAT BOOK 3, PAG-ES 101 AND 102, PUBLIC RECORDS OF ORANGE COUNTY, FLORIDA. Parcel ID #: 24-23-32-1165-21-040 Property Address: 0 Ralston Street, Orlando, FL 32833

3. Plaintiff’s title to the above described Property is derived by virtue of that certain Tax Deed issued on the February 7, 2019 from the Orange County Comptroller to the Plaintiff, and recorded on February 7, 2019 bearing Doc # 20190080052. A copy of said Tax Deed (“Tax Deed”) is attached as Exhibit “A”.

4. Claims of the Defendants. Prior to the recording of the

Tax Deed, the record owners of the property was Defendant, THOMAS DULL, who may claim an interest in the Property by virtue of that certain Special Warranty Deed recorded in O.R. Book 3325, Page 295, Public Records of Orange County, Florida, but it’s interest, if any, is subordinate and inferior to that of Plaintiff herein. A copy of the Special Warranty Deed (“Special Warrnty Deed”) is attached as Exhibit “B”. 5. Notices of the Tax Deed application and sale of the property were provided, in the manner required by law, to all those who were required by law to be notified.

6. Defendants, and all others with an interest in the property, either negligently failed to pay taxes or decided to not pay taxes on the Property. 7. Plaintiff was the successful bidder for the property with the successful bid amount, documentary stamps, and recording fees as shown on the Tax Deed.

8. All conditions precedent to this action have been met or waived.

9. No individual defendant or unknown party has any right to possession of the property, and the Plaintiff is the true and correct owner of said property. 10. Any and all claims, rights, title, or interest of Defendants and/or any party claiming by, under, or through them to the real property described herein had been extinguished by the Tax Deed described herein; and Plaintiff is the true record title owner to the real property and the legal and equitable owner thereof in fee simple, and as such, is entitled to have its title to the real property quieted and confirmed by the Court under the provisions of F.S. 65.081, 197.522(1)(d), and 197.552, Florida Statutes, with an immediate right of possession pursuant to Section 197.562, Florida Statutes.

11. None of the lands constituting the subject matter of this suit are held by the U.S. Government or by the State of Florida and said governmental bodies have relinquished or conveyed all of their right, title or interest in and to said lands and each and every parcel thereof, by patent, statute or other appropriate actions, as shown by entry in the Public Records of Orange County, Florida.

12. Pleading in the alternative, Plaintiff request that if this Court determines that the Tax Deed title of Plaintiff is void as to Defendants, the Court determine in its final judgment that Plaintiff holds a good and valid lien on the Property for the amount of money paid by Plaintiff for the Tax Deed, plus costs of documentary stamps and recording the deed together with interest thereon, at the statutory rate, and the costs of this action, including attorney’s fees and attorney’s fees incurred on appeals. WHEREFORE, Plaintiff, being without remedy save in a court of equity, demands as follows: A. That upon final ruling, Plaintiff prays that it be granted a decree declaring it and its successors in title to be the owner in fee simple title to the property herein involved and described in this Complaint, as its interest may appear, and to have clear fee simple title thereto established, quieted, and confirmed in Plaintiff. B. That Defendants are required to set forth the nature of their claims in and to the above described real property and that all adverse claims by Defendants or those claiming by, through, under, or against Defendants, be determined by judgment of this Court to be null and void as against Plaintiff.

C. That all right, title, and interest of Defendants and those parties claiming by, through, under, or against Defendants be forever quieted and confirmed in Plaintiff. D. The Defendants and those parties claiming by, through, under, or against Defendants be perpetually enjoined from asserting any right, title, claim, or interest in and to the above described real property. E. That in the event the Tax Deed title of Plaintiff is invalidated, Plaintiff’s stator lien for the amount paid for the tax deed together with interest thereon, costs, and attorneys fees be foreclosed and that the subject real property be sold by the clerk of the court to satisfy said lien.

F. That the Court grant such other and further relief as it may deem proper.
