Recent Abuse of Comparative Advantage Cases in Japan: Focusing on cases of Agricultural Cooperatives

Naoki OKAMOTO This article introduces and examines abuses of recent abuse cases in Japan. There are cases where prohibition provisions on abuse of comparative advantage have been applied to the acts of agricultural cooperatives. However, there are instances where other prohibition provisions have been applied to agricultural cooperatives, and the application of the law is not necessarily stable. This article will introduce examples of agricultural cooperatives located in Hokkaido and introduce cases where other provisions are applied to agricultural cooperatives. After that, this article will examine why the abuse provision was applied and point out the problem that would occur in the case of agricultural cooperatives.
