キ ー ワ ー ド:国 連,安 保 理 決 議1325,女 性,平 和,安 全 2011年10月7日,ノ ル ウ ェ ー に あ る ノ ー ベ ル 賞 委 員 会 が2011年 の 平 和 賞 受 賞 者 を 発 表 し た 。 今 回 は,リ ベ リ ア の エ レ ン ・サ ー リ ー フ 大 統 領(Ellen JohnsonSirleaf),リ ベ リ ア の 平 和 運 動 家 で あ る レ イ マ ・ボ ウ イ 女 史(Leymah Gbowee),お よ び 中 東 イ エ メ ン の 反 政 府 活 動 家 で あ る タ ワ ッ ク ル ・カ ル マ ン (TawakkolKarman)の3人 の 女 性 が 共 同 受 賞 し た 。 委 員 会 は 授 賞 の 理 由 と し て,3人 が 国 連 安 保 理 決 議1325(2000)に 規 定 す る平 和 構 築(peacebuilding)へ の 女 性 の 参 加 に 貢 献 し た こ と を 挙 げ た 。 委 員 会 が 受 賞 者 を 発 表 し た 際 の 記 者 会 見 と質 疑 応 答 の 動 画(7分 間)は,ノ ー ベ ル財 団 の ホ ー ム ペ ー ジ で 鑑 賞 で き る (http://www.nobelprize.org/nobel_prize/peace/laureates/2011/announce-ment.html)o 今 か ら約ll年 前 の2000年10月,国 連 安 保 理 は 決 議1325「 女 性,平 和,安 全 」(Women,PeaceandSecurity)(S/RES/1325(2000))を 採 択 し た 。 同 決 議 は,1948年12月 に 採 択 さ れ た 国 連 総 会 決 議 「世 界 人 権 宣 言 」(総 会 決 議217 A(III))と 比 べ る と は る か に 知 名 度 は低 い が,そ の 意 義 は決 して 小 さ くな い 。 安 保 理 決 議1325は,「 安 全 保 障 理 事 会 決 議 と して は じめ て,戦 争 が 女 性 に 及 ぼ す 独 特 の,不 当 に 大 き な 影 響 を 具 体 的 に 取 り上 げ,紛 争 の 解 決 と予 防,そ して 平 和 構 築 和 平 仲 介,平 和 維 持 活 動 の あ ら ゆ る 段 階 へ の 女 性 の 貢 献 を 強 調 し た 」(国 連 広 報 セ ン タ ー,「 背 景 資 料 女 性 と平 和,安 全 に 関 す る安 保 理 決

桃 山学 院 大 学 人 間 科 学No.42 議1325(2000)10周 年 ∼ 安 全 保 障 決 議1325:重 要 な 転 機 ∼ 」,プ レ ス リ リ ー ス10-084-J,2010年10月27日,http://unicorjp/unic/pressrelease/1875,2011 年12月10日 ア ク セ ス)も の で あ っ た 。 安 保 理 決 議1325が 採 択 さ れ た 背 景 に は,冷 戦 構 造 の 崩 壊 と民 族 紛 争 の 激 化 が あ っ た 。1989年ll月 の ベ ル リ ン の 壁 崩 壊,1990年10月 の ドイ ツ再 統 一,1991 年12月 の ソ 連 崩 壊 と,1980年 代 の 終 わ りか ら1990年 代 に か け て,国 際 社 会 の 構造 は 劇 的 に 変 化 し た 。 冷 戦 の 終 結 が 軍 事 費 の 削 減 を も た ら し,貧 困 対 策 や 環 境 保 護 が 推 進 さ れ る の で は な い か とい う 「平 和 の 配 当 」 へ の 期 待 も膨 ら ん だ 。 しか し,ア メ リ カ と ソ 連 が 紛 争 に 介 入 す る お そ れ が な く な る と,各 地 で 抑 え ら れ て い た 民 族 紛 争 が む し ろ 再 燃 し た 。 と く に,1991年 か ら1995年 ま で 続 い た 旧 ユ ー ゴ ス ラ ビ ア の ボ ス ニ ア 紛 争 で は,女 性 に 対 す る 性 暴 力 が 民 間 人 を 恐 怖 に 陥 れ る 戦 争 の 手 段 と して 積 極 的 に 用 い られ た 。 こ の よ う な 状 況 下,1993年12月20日 に 国 連 総 会 決 議 「女 性 に 対 す る 暴 力 の 撤 廃 に 関 す る 宣 言 」(DeclarationontheEliminationofViolenceagainst Women)(A/RES/48/104(1993))が コ ン セ ン サ ス で 採 択 さ れ た(同 決 議 を 掲 載 し た 総 会 文 書 の 日付 は1994年2月23日)。 古 今 東 西,武 力 紛 争 下 の 女 性 は 性 暴 力 に さ ら さ れ る こ とが 多 か っ た 。 同 宣 言 は,前 文 第6段 落 で 女 性 に 対 す る 暴 力 を 女 性 の 人 権 の 侵 害 と して 強 く非 難 す る 。 そ して,第1項 で 女 性 に 対 す る 暴 力 を 定 義 し,第2項 で 暴 力 の 具 体 的 な 形 態 を 掲 げ,第3項 で 女 性 の 守 ら れ る べ き人 権 を世 界 人 権 宣 言,2つ の 国 際 人 権 規 約 な ど を 引 用 し な が ら明 示 し た 。 だ が,国 連 総 会 の 決 議 に,国 際 社 会 の 大 多 数 の 意 向 を 示 す とい う 意 義 や,国 際 人 権 基 準 の ガ イ ドラ イ ン を 設 定 す る とい う 意 義 は あ っ て も,法 的 拘 束 力 は な い 。 国 連 の 中 で 唯 一,加 盟 国 に 対 して 法 的 拘 束 力 の あ る 決 議 を 採 択 で き る 機 関 は,安 全 保 障 理 事 会 で あ る 。 国 際 紛 争 が 発 生 し た 場 合,国 連 憲 章 第6章 に 基 づ き,当 事 国 は 平 和 的 解 決(交 渉 斡 旋,調 停,仲 裁,裁 判 な ど)を め ざ す 。 が,平 和 的 な 方 法 で 解 決 で き な か っ た 場 合,あ る い は,武 力 に よ る 侵 略 な ど で 最 初 か ら平 和 的 解 決 が 不 可 能 で あ る こ とが 明 白 な 場 合,国 連 憲 章 第7章 に

よ っ て,経 済 制 裁 や 外 交 関 係 の 断 絶(41条),武 力 の 行 使(42条)が 用 い ら れ る 。 安 保 理 決 議1325は,第41条 あ る い は 第42条 に基 づ く強 制 措 置 を 国 連 加 盟 国 に 要 請 す る もの で は な い が,安 保 理 が 女 性 に 対 す る 暴 力 を 正 面 か ら捉 え た 事 実 は 重 要 で あ っ た 。 そ も そ も,1945年10月 に 効 力 発 生 した 国 連 憲 章 は,第1条 第3項 で 基 本 的 人 権 の 尊 重 を 規 定 し,そ の 中 で 性 に よ る 差 別 は 禁 止 さ れ て い る 。 だ が,女 性 の 人 権 は 国 連 の 重 要 事 項 で は な か っ た 。 経 済 社 会 理 事 会 の 機 能 委 員 会 の1つ, 女 性 の 地 位 委 員 会(CommissionontheStatusofWomen:CSW)に あ ら ゆ る 女 性 問 題 が 送 られ た が,CSWは 政 治 的 に 強 力 な メ ッセ ー ジ を 発 信 す る 力 を 与 え られ て い な か っ た 。 国 連 の 活 動 の 中 で 女 性 の 人 権 が 積 極 的 に 取 り上 げ ら れ る よ う に な っ た の は,1975年 が 国 際 女 性 年(lnternationalWomen'sYear)と 指 定 さ れ,同 年 に 「国 連 女 性 の10年 」(U.N.DecadeforWomen)が 開 始 し て 以 降 で あ る 。 国 連 憲 章 な ど条 約 上 に 規 定 さ れ た 「法 律 上 の 平 等 」(dejureequality)に 満 足 せ ず, 「事 実 上 の 平 等 」(defactoequality)を 実 現 す る た め,1975年 に 第1回 世 界 女 性 会 議(メ キ シ コ 会 議)が 開 催 さ れ た 。1979年 に は,国 連 女 性 差 別 撤 廃 条 約 が 国 連 総 会 で 採 択 さ れ た 。 正 式 名 称 は,「 女 性 に 対 す る あ ら ゆ る 形 態 の 差 別 の 撤 廃 に 関 す る 条 約 」(ConventionontheEliminationofAllFormsofDiscrimi-nationagainstWomen)で あ る 。 ち な み に,同 条 約 は 「女 性 に と っ て の 国 際 的 権 利 の 憲 章 」(aninternationalbillofrightsforwomen)と も呼 ば れ る(http: //www.un.org/womenwatch/directory/instruments _treaties_1003.htm,2012 年1月5日 ア ク セ ス)。 1980年 の 第2回 世 界 女 性 会 議(コ ペ ンハ ー ゲ ン会 議)の 会 期 中,条 約 の 署 名 式 が 開 催 さ れ,日 本 も署 名 し た 。 日本 政 府 団 団 長 は,日 本 で 初 め て の 女 性 大 使 と な っ た 高 橋 展 子 駐 デ ンマ ー ク 大 使(当 時 。 故 人)で あ る 。 高 橋 は 外 務 省 出 身 で は な く,労 働 省 婦 人 少 年 局 局 長 の 経 験 者 で あ っ た 。 1985年,第3回 世 界 女 性 会 議(ナ イ ロ ビ会 議)が 開 催 さ れ,多 くの 成 果 と と も に 「国 連 女 性 の10年 」 が 終 了 し た 。 同 年5月,日 本 の 国 会 で 男 女 雇 用 機

桃 山学 院 大 学 人 間 科 学No.42 会 均 等 法 が 成 立 し た が,こ れ に よ り条 約 批 准 に 必 要 な 国 内 法 の 制 定 が 終 わ り, 日本 政 府 は ナ イ ロ ビ 会 議 終 了 直 前 に 条 約 批 准 書 を 国 連 事 務 局 に 提 出 す る こ と が で き た 。1995年 の 第4回 世 界 女 性 会 議(北 京 会 議)で は,女 性 の 人 権 か ら さ ら に 発 展 し,ジ ェ ン ダ ー(社 会 的 に 作 られ た 性)の 視 点 で 人 権 問 題 を 見 直 す 「ジ ェ ン ダ ー の 主 流 化 」(gendermainstreaming)が 主 要 な 課 題 と な っ た 。 ま た,女 性 差 別 撤 廃 条 約 の 国 内 実 施 を さ ら に 促 進 す る た め,北 京 宣 言 お よ び 行 動 綱 領 が 採 択 さ れ た 。 1999年10月 に,女 性 差 別 撤 廃 条 約 に 付 随 し た 選 択 議 定 書 が 国 連 総 会 で 採 択 さ れ,女 性 の 人 権 に 関 す る 個 人 通 報 と調 査 制 度 が 整 備 さ れ た 。 個 人 通 報 制 度 は,個 人 が 条 約 の 監 視 機 関 で あ る 女 性 差 別 撤 廃 委 員 会 に 対 して,一 定 の 要 件 下,締 約 国 に よ る 人 権 侵 害 を 直 接 申 立 て る こ と を 認 め る もの で あ る(選 択 議 定 書 第2条 か ら第7条)。 委 員 会 に よ る 調 査 は,「 深 刻 か つ 系 統 的 な 人 権 侵 害 」 が 存 在 す る とい う 信 頼 で き る 情 報 が も た ら され た 場 合(同 第8条),締 約 国 の 同 意 が あ れ ば,女 性 差 別 撤 廃 委 員 会 が 直 接 締 約 国 の 領 域 内 で 調 査 を 行 う(同 第8条 か ら第10条)。 選 択 議 定 書 の 採 択 に よ っ て,「 女 性 に 対 す る暴 力 」 へ の 取 り組 み が 強 化 さ れ る と期 待 さ れ た 。 2000年 夏,ニ ュ ー ヨ ー ク の 国 連 本 部 で,第23回 国 連 特 別 総 会 「女 性2000 年 会 議:21世 紀 に 向 け て の ジ ェ ン ダ ー の 平 等,開 発 お よ び 平 和 」(略 称 「女 性 2000年 会 議 」)が 開 催 さ れ た 。 こ こ で は,北 京 宣 言 お よ び 行 動 綱 領 を実 施 す る た め の イ ニ シ ア テ ィ ブ が 採 択 さ れ た 。 こ の よ う に1975年 か ら始 ま っ て25年 間 に わ た り女 性 の 人 権,お よ び ジ ェ ン ダ ー の 平 等(genderequality)が 取 り 上 げ られ て き た こ とが,2000年10月 の 安 保 理 決 議1325に つ な が っ た と い え る 。 近 年,安 保 理 決 議1325を 補 完 す る た め に3つ の 安 保 理 決 議 が 採 択 さ れ た 。 第1に,2008年6月19日 採 択 の 決 議1820(S/RES/1820(2008))は,「 女 性 と平 和 と安 全 」(WomenandPeaceandSecurity)と 題 し,性 暴 力 が 国 際 の 平 和 と安 全 を 脅 か す ゆ え に,武 力 紛 争 下 の 女 性 と女 児 を 保 護 す る た め の 措 置 を と る よ う求 め て い る(http://www.fco.gov.uk/en/global-issues/women-peace一

security/,2010年12月10日 ア ク セ ス)。 第2に,2009年9月30日 に採 択 さ れ た 決 議1888(2009)「 女 性 と平 和 と安 全 」(WomenandPeaceandSecurity) は,戦 争 の 戦 術 と して 性 暴 力 を 使 う こ と を 停 止 す る 戦 略 を 適 用 す る よ う 規 定 す る(同)。 第3に,2009年10月5日 に 採 択 さ れ た 決 議1889(2009)「 女 性 と平 和 と安 全 」(WomenandPeaceandSecurity)は,決 議1325の 実 施 状 況 を 強 化 し監 視 す る よ う 求 め る(同)。2010年12月16日 に は,3つ の 安 保 理 決 議,と く に 決 議1888を さ ら に 強 化 す る た め に,新 た な 安 保 理 決 議1960(S/ RES/1960(2010))が 採 択 さ れ た 。 こ の ほ か,安 保 理 で は 毎 年 決 議1325に 関 す る 討 議 を 行 い,議 長 声 明 を 発 表 す る こ とで,女 性 に 対 す る 暴 力 の 撤 廃 に 関 す る 問 題 を 提 起 し続 け て きた 。 最 近 で は,2010年10月26日 に 「女 性 ・平 和 ・安 全 」 に 関 す る 公 開 討 論 に 基 づ き,安 保 理 議 長 声 明(S/PRST/2010/22)の 中 で,国 連 の 女 性 お よ び ジ ェ ン ダ ー に 関 す る 諸 機 関 が 統 合 さ れ て 作 られ たUNWomen _{,正 式 名 称TheUNEntity} forGenderEqualityandtheEmpowermentofWomenを 設 立 した2010年7 月21日 の 国 連 総 会 決 議(A/RES/64/289)を 歓 迎 す る と し た(S/PRST/2010 /22,para.3)。2011年10月28日 に は,安 保 理 議 長 声 明(S/PRST/2011/20) の 中 で,女 性 差 別 撤 廃 条 約 及 び 同 選 択 議 定 書 の 義 務 に す べ て の 締 約 国 が 完 全 に 従 う よ う 促 し(S/PRST/2011/20,Para.3),「 女 性 ・平 和 ・安 全 」 に 関 す る2011年9月29日 の 国 連 事 務 総 長 報 告 書(s/2011/598)を 歓 迎 し た(ibid,, para.5)。 だ が,こ れ ら文 書 は,あ く ま で の 国 連 の 他 の 機 関 の 行 動 を 賞 賛 す る もの で,安 保 理 自 身 が 積 極 的 な 行 動 を と っ た わ け で は な い 。 そ れ ゆ え,ノ ー ベ ル 賞 委 員 会 が2011年 に ア フ リ カ の 女 性 活 動 家3名 に 平 和 賞 を授 賞 し た こ と は,安 保 理 が 「女 性 ・平 和 ・安 全 」 の 討 論 と声 明 発 表 に 終 わ ら な い よ う, 平 和 賞 の 知 名 度 と注 目度 を 存 分 に 利 用 して,側 面 か ら国 連 の 活 動 を 支 援 し た と もい え る 。 以 上 見 て き た よ う に,安 保 理 決 議1325(2000),国 連 総 会 決 議 「女 性 に対 す る 暴 力 の 撤 廃 に 関 す る 宣 言 」(1993),国 連 女 性 差 別 撤 廃 条 約(1979)と そ の 選 択 議 定 書(1999)は,互 い に 密 接 に 結 び つ い て い る 。 本 稿 は,国 連 の 女 性

態 の 調 整 ま た は解 決 を平 和 的 手 段 に よ って 且 つ 正 義 及 び国 際 法 の 原 則 に従 っ

て 実 現 す る こ と。

経 済 的,社 会 的,文 化 的 ま た は人 道 的 性 質 を有 す る国 際 問 題 を解 決

す る こ とにつ い て,並

び に人 種,性,言

語 ま た は宗 教 に よ る差 別 な くす べ て

す べ て の 加 盟 国 は,そ の 国 際 関 係 にお い て,武 力 に よ る威 嚇 又 は武

力 の 行 使 を,い か な る 国の 領 土 保 全 又 は政 治 的 独 立 に対 す る もの も,ま た,

国際 連 合 の 目的 と両 立 しない 他 の い か な る方 法 に よ る もの も慎 ま な けれ ば な

国 際 連合 加 盟 国 は,安 全 保 障 理事 会 の決 定 を この憲 章 に従 っ て受 諾

し且 つ 履 行 す る こ とに 同意 す る。

平 和 に対 す る脅 威,平 和 の 破 壊 及 び侵 略 行 為 に関 す る行 動

第39条

安 全 保 障理 事 会 は,平 和 に対 す る脅 威

平 和 の破 壊 又 は侵 略行 為 の

存 在 を決 定 し,並 び に,国 際 の 平 和 及 び安 全 を維 持 し又 は 回復 す る ため に,

勧 告 を し,又 は第41条

及 び 第42条

に従 って い か な る措 置 を とるか を決 定 す

る。

第41条

安 全保 障理 事 会 は,そ の決 定 を実施 す る ため に,兵 力 の 使用 を伴 わ

ない い か な る措 置 を使 用 す べ きか を決 定 す る こ とが で き,且 つ,こ の 措 置 を

適 用 す る よ う に 国際 連 合 加 盟 国 に要 請 す る こ とが で きる。 この 措 置 は,経 済

関 係 及 び鉄 道,航 海,航 空,郵 便,電 信,無 線 通 信 そ の 他 の 運 輸 通 信 の 手 段

の 全 部 又 は一 部 の 中断 並 び に外 交 関 係 の 断 絶 を含 む こ とが で きる。

第42条

安 全 保 障理 事 会 は,第41条

に定 め る措 置 で は不 充 分 で あ ろ う と認

め,又

は不 充 分 な こ とが 判 明 した と認 め る と きは,国 際 の 平 和 及 び安 全 の 維

持 又 は 回復 に必 要 な空 軍,海 軍 ま た は陸 軍 の 行 動 を とる こ とが で きる。 この

行 動 は,国 際 連 合 加 盟 国の 空 軍

第51条

この 憲 章 の いか な る規 定 も,国 際 連合 加 盟 国 に対 して武 力攻 撃 が 発

生 した場 合 に は,安 全 保 障 理 事 会 が 国 際 の 平 和 及 び安 全 の 維 持 に必 要 な措 置

を とる まで の 問,個 別 的 又 は集 団的 自衛 の 固有 の権 利 を害 す る もの で は ない 。

この 自衛 権 の 行 使 に当 って 加 盟 国 が とっ た措 置 は,直 ち に安 全 保 障 理 事 会 に

報 告 しな けれ ば な らない 。 ま た,こ の 措 置 は,安 全 保 障 理 事 会 が 国 際 の 平 和

及 び安 全 の 維 持 ま た は 回復 の ため に必 要 と認 め る行 動 をい つ で も とる この 憲

章 に基 く権 能 及 び責 任 に対 して は,い か な る影 響 も及 ぼす もの で は ない 。

TheGeneralAssembly, Recognizingtheurgentneedfortheuniversalapplicationtowomenofthe rightsandprincipleswithregardtoequality,security,liberty,integrityand

dignityofallhumanbeings, Notingthatthoserightsandprinciplesareenshrinedininternationalinstru-ments,includingtheUniversalDeclarationofHumanRights,theInternational CovenantonCivilandPoliticalRights,theInternationalCovenantonEco-nomic,SocialandCulturalRights,theConventionontheEliminationofAll FormsofDiscriminationagainstWomenandtheConventionagainstTorture andOtherCruel,InhumanorDegradingTreatmentorPunishment, RecognizingthateffectiveimplementationoftheConventionontheElimina-tionofAllFormsofDiscriminationagainstWomenwouldcontributetothe eliminationofviolenceagainstwomenandthattheDeclarationontheElimi-nationofViolenceagainstWomen,setforthinthepresentresolution,will strengthenandcomplementthatprocess, Concernedthatviolenceagainstwomenisanobstacletotheachievement ofequality,developmentandpeace,asrecognizedintheNairobiForward‐ lookingStrategiesfortheAdvancementofWomen,inwhichasetofmeasures tocombatviolenceagainstwomenwasrecommended,andtothefullimple-mentationoftheConventionontheEliminationofAllFormsofDiscrimination againstWomen, Affirmingthatviolenceagainstwomenconstitutesaviolationoftherights andfundamentalfreedomsofwomenandimpairsornullifiestheirenjoyment ofthoserightsandfreedoms,andconcernedaboutthelong‐standingfailure toprotectandpromotethoserightsandfreedomsinthecaseofviolence againstwomen,

桃 山 学 院 大 学 人 間 科 学No.42 Recognizingthatviolenceagainstwomenisamanifestationofhistorically unequalpowerrelationsbetweenmenandwomen,whichhaveledtodomina-tionoveranddiscriminationagainstwomenbymenandtotheprevention ofthefulladvancementofwomen,andthatviolenceagainstwomenisone ofthecrucialsocialmechanismsbywhichwomenareforcedintoasubordi-natepositioncomparedwithmen, Concernedthatsomegroupsofwomen,suchaswomenbelongingtominor-itygroups,indigenouswomen,refugeewomen,migrantwomen,womenliving inruralorremotecommunities,destitutewomen,womenininstitutionsor indetention,femalechildren,womenwithdisabilities,elderlywomenand womeninsituationsofarmedconflict,areespeciallyvulnerabletoviolence, Recallingtheconclusioninparagraph230ftheannextoEconomicandSocial Councilresolution1990/150f24May1990thattherecognitionthatviolence againstwomeninthefamilyandsocietywaspervasiveandcutacrosslines ofincome,classandculturehadtobematchedbyurgentandeffectivesteps toeliminateitsincidence, RecallingalsoEconomicandSocialCouncilresolution1991/180f30May1991, inwhichtheCouncilrecommendedthedevelopmentofaframeworkforan internationalinstrumentthatwouldaddressexplicitlytheissueofviolence againstwomen, Welcomingtherolethatwomen'smovementsareplayingindrawingincreas-ingattentiontothenature,severityandmagnitudeoftheproblemofviolence againstwomen,

Alarmedthatopportunitiesforwomentoachievelegal,social,politicaland economicequalityinsocietyarelimited,interalia,bycontinuingandendemic violence, Convincedthatinthelightoftheabovethereisaneedforaclearandcom-prehensivedefinitionofviolenceagainstwomen,aclearstatementofthe rightstobeappliedtoensuretheeliminationofviolenceagainstwomenin allitsforms,acommitmentbyStatesinrespectoftheirresponsibilities,and acommitmentbytheinternationalcommunityatlargetotheeliminationof violenceagainstwomen, Solemnlyproc!aimsthefollowingDeclarationontheEliminationofViolence againstWomenandurgesthateveryeffortbemadesothatitbecomesgen-erallyknownandrespected: Article1 ForthepurposesofthisDeclaration,theterm"violenceagainstwomen"means anyactofgender-basedviolencethatresultsin,orislikelytoresultin,physi-cal,sexualorpsychologicalharmorsufferingtowomen,includingthreatsof suchacts,coercionorarbitrarydeprivationofliberty,whetheroccurringin publicorinprivatelife. Article2 Violenceagainstwomenshallbeunderstoodtoencompass,butnotbelimited to,thefollowing:

(a)Physical,sexualandpsychologicalviolenceoccurringinthefamily,includ-ingbattering,sexualabuseoffemalechildreninthehousehold,dowry-related

violence,maritalrape,femalegenitalmutilationandothertraditionalpractices

harmfultowomen,non-spousalviolenceandviolencerelatedtoexploitation;

(b)Physical,sexualandpsychologicalviolenceoccurringwithinthegeneral

community,includingrape,sexualabuse,sexualharassmentandintimidation

atwork,ineducationalinstitutionsandelsewhere,traffickinginwomenand

forcedprostitution;

(c)Physical,sexualandpsychologicalviolenceperpetratedorcondonedby

theState,whereveritoccurs.

Article3

Womenareentitledtotheequalenjoymentandprotectionofallhumanrights

andfundamentalfreedomsinthepolitical,economic,social,cultural,civilor

anyotherfield.Theserightsinclude,interalia

(a)Therighttolife;

(b)Therighttoequality;

(c)Therighttolibertyandsecurityofperson;

(d)Therighttoequalprotectionunderthelaw;

(e)Therighttobefreefromallformsofdiscrimination;

(f)Therighttothehigheststandardattainableofphysicalandmentalhealth;

(g)Therighttojustandfavourableconditionsofwork

(h)Therightnottobesubjectedtotorture,orothercruel,inhumanordegrad-ingtreatmentorpunishment.

Article4 Statesshouldcondemnviolenceagainstwomenandshouldnotinvokeany custom,traditionorreligiousconsiderationtoavoidtheirobligationswithre-specttoitselimination.Statesshouldpursuebyallappropriatemeansand withoutdelayapolicyofeliminatingviolenceagainstwomenand,tothisend, should:

(a)Consider,wheretheyhavenotyetdoneso,ratifyingoraccedingtothe

ConventionontheEliminationofAllFormsofDiscriminationagainstWomen

orwithdrawingreservationstothatConvention;

(b)Refrainfromengaginginviolenceagainstwomen;

(c)Exerciseduediligencetoprevent,investigateand,inaccordancewithna-tionallegislation,punishactsofviolenceagainstwomen,whetherthoseacts

areperpetratedbytheStateorbyprivatepersons;

islationtopunishandredressthewrongscausedtowomenwhoaresubjected

toviolence;womenwhoaresubjectedtoviolenceshouldbeprovidedwith

accesstothemechanismsofjusticeand,asprovidedforbynationallegislation,

tojustandeffectiveremediesfortheharmthattheyhavesuffered;States

shouldalsoinformwomenoftheirrightsinseekingredressthroughsuch

mechanisms;

(e)Considerthepossibilityofdevelopingnationalplansofactiontopromote

theprotectionofwomenagainstanyformofviolence,ortoincludeprovisions

forthatpurposeinplansalreadyexisting,takingintoaccount,asappropriate,

suchcooperationascanbeprovidedbynon-governmentalorganizations,par-ticularlythoseconcernedwiththeissueofviolenceagainstwomen;

(f)Develop,inacomprehensiveway,preventiveapproachesandallthose

measuresofalegal,political,administrativeandculturalnaturethatpromote

theprotectionofwomenagainstanyformofviolence,andensurethatthe

re-victimizationofwomendoesnotoccurbecauseoflawsinsensitivetogen-derconsiderations,enforcementpracticesorotherinterventions;

(g)Worktoensure,tothemaximumextentfeasibleinthelightoftheiravail-

ableresourcesand,whereneeded,withintheframeworkofinternationalco-operation,thatwomensubjectedtoviolenceand,whereappropriate,their

childrenhavespecializedassistance,suchasrehabilitation,assistanceinchild

careandmaintenance,treatment,counselling,andhealthandsocialservices,

facilitiesandprogrammes,aswellassupportstructures,andshouldtakeall

otherappropriatemeasurestopromotetheirsafetyandphysicalandpsycho-logicalrehabilitation;

(h)Includeingovernmentbudgetsadequateresourcesfortheiractivitiesre-latedtotheeliminationofviolenceagainstwomen;

(i)Takemeasurestoensurethatlawenforcementofficersandpublicofficials

responsibleforimplementingpoliciestoprevent,investigateandpunishvio-lenceagainstwomenreceivetrainingtosensitizethemtotheneedsofwomen;

(1)Adoptallappropriatemeasures,especiallyinthefieldofeducation,tomod-

ifythesocialandculturalpatternsofconductofmenandwomenandtoelimi-nateprejudices,customarypracticesandallotherpracticesbasedontheidea

oftheinferiorityorsuperiorityofeitherofthesexesandonstereotypedroles

formenandwomen;

(k)Promoteresearch,collectdataandcompilestatistics,especiallyconcern-ingdomesticviolence,relatingtotheprevalenceofdifferentformsofviolence

againstwomenandencourageresearchonthecauses,nature,seriousness

andconsequencesofviolenceagainstwomenandontheeffectivenessofmeas-

uresimplementedtopreventandredressviolenceagainstwomen;thosesta-tisticsandfindingsoftheresearchwillbemadepublic;

(1)Adoptmeasuresdirectedtowardstheeliminationofviolenceagainst

womenwhoareespeciallyvulnerabletoviolence;

(m)Include,insubmittingreportsasrequiredunderrelevanthumanrights

instrumentsoftheUnitedNations,informationpertainingtoviolenceagainst

womenandmeasurestakentoimplementthepresentDeclaration;

(n)Encouragethedevelopmentofappropriateguidelinestoassistintheim一

(o)Recognizetheimportantroleofthewomen'smovementandnon-govern-mentalorganizationsworldwideinraisingawarenessandalleviatingthe

(p)Facilitateandenhancetheworkofthewomen'smovementandnon‐gov- ernmentalorganizationsandcooperatewiththematlocal,nationalandre-gionallevels;

(q)Encourageintergovernmentalregionalorganizationsofwhichtheyare

memberstoincludetheeliminationofviolenceagainstwomenintheirpro-grammes,asappropriate.

Article5 TheorgansandspecializedagenciesoftheUnitedNationssystemshould, withintheirrespectivefieldsofcompetence,contributetotherecognitionand realizationoftherightsandtheprinciplessetforthinthepresentDeclaration and,tothisend,should,interalias

(a)Fosterinternationalandregionalcooperationwithaviewtodefiningre-

gionalstrategiesforcombatingviolence,exchangingexperiencesandfinanc-ingprogrammesrelatingtotheeliminationofviolenceagainstwomen;

(b)Promotemeetingsandseminarswiththeaimofcreatingandraising awarenessamongallpersonsoftheissueoftheeliminationofviolenceagainst women;

(c)FostercoordinationandexchangewithintheUnitedNationssystembe-tweenhumanrightstreatybodiestoaddresstheissueofviolenceagainst

womeneffectively;

(d)IncludeinanalysespreparedbyorganizationsandbodiesoftheUnited

Nationssystemofsocialtrendsandproblems,suchastheperiodicreports

ontheworldsocialsituation,examinationoftrendsinviolenceagainstwomen;

(e)EncouragecoordinationbetweenorganizationsandbodiesoftheUnited

Nationssystemtoincorporatetheissueofviolenceagainstwomenintoongo-ingprogrammes,especiallywithreferencetogroupsofwomenparticularly

vulnerabletoviolence;

(f)Promotetheformulationofguidelinesormanualsrelatingtoviolence

againstwomen,takingintoaccountthemeasuresreferredtointhepresent

Declaration;

(g)Considertheissueoftheeliminationofviolenceagainstwomen,asappro-

priate,infulfillingtheirmandateswithrespecttotheimplementationofhu-manrightsinstruments;

(h)Cooperatewithnon-governmentalorganizationsinaddressingtheissue

ofviolenceagainstwomen.

RecallingalsothecommitmentsoftheBeijingDeclarationandPlatform forAction(A/52/231)aswellasthosecontainedintheoutcomedocument

ofthetwenty-thirdSpecialSessionoftheUnitedNationsGeneralAssembly entitled≪Women2000:GenderEquality,DevelopmentandPeaceforthe Twenty-FirstCentury≫(A/S-23/10/Rev.1),inparticularthoseconcerning womenandarmedconflict, BearinginmindthepurposesandprinciplesoftheCharteroftheUnited NationsandtheprimaryresponsibilityoftheSecurityCouncilundertheChar-terforthemaintenanceofinternationalpeaceandsecurity,

Expressingconcernthatcivilians,particularlywomenandchildren,ac-

countforthevastmajorityofthoseadverselyaffectedbyarmedconflict,in-

eludingasrefugeesandinternallydisplacedpersons,andincreasinglyaretar-getedbycombatantsandarmedelements,andrecognizingtheconsequent

impactthishasondurablepeaceandreconciliation,

Reaffirmingtheimportantroleofwomeninthepreventionandresolu-tionofconflictsandinpeace-building,andstressingtheimportanceoftheir equalparticipationandfullinvolvementinalleffortsforthemaintenanceand promotionofpeaceandsecurity,andtheneedtoincreasetheirroldindeci-sion-makingwithregardtoconflictpreventionandresolution, Reaffirmingalsotheneedtoimplementfullyinternationalhumanitarian andhumanrightslawthatprotectstherightsofwomenandgirlsduringand afterconflicts, Emphasizingtheneedforallpartiestoensurethatmineclearanceand mineawarenessprogrammestakeintoaccountthespecialneedsofwomen andgirls,

Recognizingalsotheimportanceoftherecommendationcontainedinthe statementofitsPresidenttothepressof8March2000forspecializedtraining forallpeacekeepingpersonnelontheprotection,specialneedsandhuman rightsofwomenandchildreninconflictsituations, Recognizingthatanunderstandingoftheimpactofarmedconflicton womenandgirls,effectiveinstitutionalarrangementstoguaranteetheirpro-tectionandfullparticipationinthepeaceprocesscansignificantlycontribute tothemaintenanceandpromotionofinternationalpeaceandsecurity, Notingtheneedtoconsolidatedataontheimpactofarmedconflicton womenandgirls, 1.UrgesMemberStatestoensureincreasedrepresentationofwomen atalldecision-makinglevelsinnational,regionalandinternationalinstitutions andmechanismsfortheprevention,management,andresolutionofconflict;

2.EncouragestheSecretary-Generaltoimplementhisstrategicplanof

action(A/49/587)callingforanincreaseintheparticipationofwomenatde-cision-makinglevelsinconflictresolutionandpeaceprocesses;

3.UrgestheSecretary-Generaltoappointmorewomenasspecialrepre一

sentativesandenvoystopursuegoodofficesonhisbehalf,andinthisregard callsonMemberStatestoprovidecandidatestotheSecretary-General,for inclusioninaregularlyupdatedcentralizedroster; 4.FurtherurgestheSecretary-Generaltoseektoexpandtheroleand contributionofwomeninUnitedNationsfield-basedoperations,andespecially amongmilitaryobservers,civilianpolice,humanrightsandhumanitarianper-sonnel: 5.Expressesitswillingnesstoincorporateagenderperspectiveinto peacekeepingoperations,andurgestheSecretary-Generaltoensurethat, whereappropriate,fieldoperationsincludeagendercomponent; 6.RequeststheSecretary-GeneraltoprovidetoMemberStatestraining guidelinesandmaterialsontheprotection,rightsandtheparticularneeds ofwomen,aswellasontheimportanceofinvolvingwomeninallpeacekeep-ingandpeacebuildingmeasures,invitesMemberStatestoincorporatethese elementsaswellasHIV/AIDSawarenesstrainingintotheirnationaltraining programmesformilitaryandcivilianpolicepersonnelinpreparationforde-ployment,andfurtherrequeststheSecretary-Generaltoensurethatcivilian personnelofpeacekeepingoperationsreceivesimilartraining; 7.UrgesMemberStatestoincreasetheirvoluntaryfinancial,technical andlogisticalsupportforgender-sensitivetrainingefforts,includingthose undertakenbyrelevantfundsandprogrammes,interalia,theUnitedNations FundforWomenandUnitedNationsChildren'sFund,andbytheOfficeof theUnitedNationsHighCommissionerforRefugeesandotherrelevantbod-ies;

(a)Thespecialneedsofwomenandgirlsduringrepatriationandresettle-mentandforrehabilitation,reintegrationandpost-conflictreconstruction;

(b)Measuresthatsupportlocalwomen'speaceinitiativesandindigenous

processesforconflictresolution,andthatinvolvewomeninalloftheimple-mentationmechanismsofthepeaceagreements;

(c)Measuresthatensuretheprotectionofandrespectforhumanrights

ofwomenandgirls,particularlyastheyrelatetotheconstitution,theelectoral

system,thepoliceandthejudiciary;

9.Callsuponallpartiestoarmedconflicttorespectfullyinternational lawapplicabletotherightsandprotectionofwomenandgirls,especiallyas civilians,inparticulartheobligationsapplicabletothemundertheGeneva Conventionsof1949andtheAdditionalProtocolstheretoof1977,theRefugee Conventionof1951andtheProtocoltheretoof1967,theConventiononthe EliminationofAllFormsofDiscriminationagainstWomenof1979andthe OptionalProtocoltheretoof1999andtheUnitedNationsConventiononthe RightsoftheChildof1989andthetwoOptionalProtocolstheretoof25May 2000,andtobearinmindtherelevantprovisionsoftheRomeStatuteofthe InternationalCriminalCourt; 10.Callsonallpartiestoarmedconflicttotakespecialmeasurestopro-tectwomenandgirlsfromgender-basedviolence,particularlyrapeandother

formsofsexualabuse,andallotherformsofviolenceinsituationsofarmed con且ict; 11.EmphasizestheresponsibilityofallStatestoputanendtoimpunity andtoprosecutethoseresponsibleforgenocide,crimesagainsthumanity,and warcrimesincludingthoserelatingtosexualandotherviolenceagainst womenandgirls,andinthisregardstressestheneedtoexcludethesecrimes, wherefeasiblefromamnestyprovisions;

12.Callsuponallpartiestoarmedconflicttorespectthecivilianandhu-

manitariancharacterofrefugeecampsandsettlements,andtotakeintoac-counttheparticularneedsofwomenandgirls,includingintheirdesign,and

recallsitsresolutions1208(1998)of19November1998and1296(2000)of19

April2000;

13.Encouragesallthoseinvolvedintheplanningfordisarmament,demo-bilizationandreintegrationtoconsiderthedifferentneedsoffemaleandmale ex-combatantsandtotakeintoaccounttheneedsoftheirdependants; 14.Reaffirmsitsreadiness,whenevermeasuresareadoptedunderArti- cle410ftheCharteroftheUnitedNations,togiveconsiderationtotheirpo-tentialimpactonthecivilianpopulation,bearinginmindthespecialneeds ofwomenandgirls,inordertoconsiderappropriatehumanitarianexemptions; 15.ExpressesitswillingnesstoensurethatSecurityCouncilmissions takeintoaccountgenderconsiderationsandtherightsofwomen,including throughconsultationwithlocalandinternationalwomen'sgroups;
