【授業概要】
20世紀後半を代表する法哲学者の⼀⼈であるRonaldDworkinの最後の論稿は国際法についてのものであった（“A New Philosophy forInternational Law”）。これが示すように、国際法やそれを中心とするグローバルな法秩序に対する法哲 学的関⼼が近年⼤きな⾼まりを⾒せている。グローバルな貧困問題、国際テロリズム、移⺠・難⺠問題など、グローバル な問題への対処が現代社会の喫緊の課題となっていることを背景として、解決のための手段であると同時に部分的には問 題の元凶とも⾒なしうるグローバルな法秩序についての議論が脚光を浴びているのである。本授業においては、このテー マに関する最新の論文を取り上げ、演習形式で理解を深める。

【授業概要】
法哲学・法思想史分野の重要基本文献から最新の議論動向までを演習形式で扱う。本学期はDavidDyzenhaus, Hard Cases in Wicked LegalSystemsを読む。「悪法も法か」という問いは法哲学の根本問題の一つであるが、本書はアパル トヘイト体制下の南アフリカの法を具体的素材としてこの問題に取り組むものである。著者は南アフリカ出身でありカナ ダで教鞭をとる法哲学者である。不正な内容の法、邪悪な内容の法は法として扱われるべきか。裁判官やその他の法主体 はそうした法に直⾯したときどのような態度をとるべきか。参加者と共に考えてみたい。

【授業概要】
本授業では、近世法に関する古典的概説書の⼀である⾦田平⼀郎『近世債権法』（法務庁資料統計局資料課、1948年）を
⼿掛かりとして、近世⺠事法制、とりわけ債権法制について考察する。歴史資料の解釈のあり⽅はもとより、本書のソ リッドな構成及び叙述を通じて、歴史的素材から如何にして当時の法制度及びそれを取り巻く背景を再現するかについて も、出来るだけ多面的かつ緻密に検討したい。

この演習では、⺠間団体による公的な基準・規格・格付け・ルール等の形成と実施の現状を理解し、理論的にどのように 既存体系に関連させ、また既存体系を修正すればよいかを、実証的かつ理論的に考える。
授業は、1回２コマ連続で⾏い、１回に教科書をおおよそ⼀章よみ、それに対応する事例について議論する。
なおこの授業は前期のヨーロッパ法特殊研究I・II（Global Administrative Lawの研究）と深く関連する。

【授業概要】
The first two weeks will be spent learning about how cases reach the Supreme Court and the process by which the Justices work. We then will begin reading cases, usually one per week. Students will be required to read the decision in the week before the class. Then, during the class time, we will dissect and discuss the case together. This is the same process used in the training of lawyers in American law schools, although we will go about it on a less hurried schedule.All cases will be drawn from the current Supreme Court term, which beganin October and will end in late June or early July. These decisions are now published immediately via the internet, so we can read them as soon as they are issued. A number of students at Waseda and at other universities in Japan who have taken this class with the same teacher have gone on to study successfully in graduate programs in the U.S.

In this class, we will read current decisions of the United States Supreme Court in their original form. In so doing, we will learn what kinds of issues are before the Court right now. The most important goal, however, is to gain experience in how to read and understand U.S. court decisions.

Grading will be based on class participation and a report,in English, of about 10 pages. The report will concern a case that each student will select individually. Class participation will include a short presentation at the end of the semester on the subject of the report. Our class will primarily be conducted in English so that students can have the experience of studying American law directly in its original form. However, questions and comments in Japanese are acceptable. Students need a level of English that is good enough to read the material and participate in the class discussion, However, fluency is not necessary. We will learn together.
The most important thing is to do your best to work with the material.
