Application for Cargo Discharge Permission

If cargo information for the pre‐departure filing is not filed by the dead line, Japan Customs sends a filer an advance notice with “SPD” code. In such case, those wishing to discharge the cargo, e.g. shipping company or shipping agent etc…, need to apply for cargo discharge

permission to the Customs office which has jurisdiction over the port where the cargo to be discharged. The cargoes received an advance notice with “SPD” code can’t be discharged without the permission to discharge by Japan Customs.

The cases an advance notice with “SPD” code is sent to the filer of the “Manifest Submission (DMF)”

or the “Advance Cargo Information Registration (AMR)” are as follows,

・ If the cargo information is not filed

・ If the cargo information is not filed by the filing deadline

In case the filer receives an advance notice with “SPD” code as below, the filer needs to conduct the Application for Cargo Discharge Permission, referring to next page.

① An advance notice with “SPD” code on the ground that the cargo information was not filed

② An advance notice with “SPD” code on the ground that the cargo information was not filed by the deadline

③ An advance notice with “SPD” code on the ground that the cargo information was not filed by the deadline(switched from “HLD”)

Procedure for the application for cargo discharge permission

① If Japan Customs sends a filer an advance notice with “SPD” code because the cargo information for

advance filing was not filed, those wishing to discharge the cargo need to request those obliged to file, or file by themselves.

② In case those wishing to discharge the cargo submit application for cargo discharge permission through NACCS, they need to conduct the Application for Cargo Discharge Permission(DNC). With regard to the input items for DNC, please refer to “Annex 17 Table of Input Fields of Application for Cargo Discharge Permission(DNC)” included in “Introduction of the Advance Filing Rules on Maritime Container Cargo Information (guidance) ”.

② ’ In case those wishing to discharge the cargo submit application for cargo discharge permission in writing, they need to submit “Application format for permission of unloading”(Customs Form C No.2090) to Japan Customs office which has jurisdiction over the port of discharge.

③ In case filers submit application for cargo discharge permission through NACCS or in writing, outside office hours of Japan Customs office which has jurisdiction over the port of discharge, filers need to contact Japan Customs in advance, just as they should do in the same occasion under the current pre‐

arrival filing.

④ If Japan Customs considers the cargo has no threats to Japan in security as a result of risk analysis of the cargo information , discharging may be permitted. Even if such a case, those obliged to file may be

penalized because the advance filing missed the deadline.

① If Japan Customs sends a filer an advance notice with “SPD” code by missing the deadline for advance filing of cargo information, the filer doesn’t have to file the cargo information again.

② In case those wishing to discharge the cargo submit application for cargo discharge permission through NACCS, they need to conduct the Application for Cargo Discharge Permission(DNC). With regard to the input items for DNC, please refer to “Annex 17 Table of Input Fields of Application for Cargo Discharge Permission(DNC)” included in “Introduction of the Advance Filing Rules on Maritime Container Cargo Information (guidance) ”.

① If those who wishing to discharge the cargo receive an advance notice with SPD code which was switched from an advance notice with HLD code, due to missing the filing deadline, they need to request those obliged to correct or/and add the cargo information received an advance notice with “HLD” code, or correct or/and add by themselves. Japan Customs instructs the items to which correction and addition are necessary by the advance notice with “SPD” code switched from “HLD” code.

② In case those wishing to discharge the cargo submit application for cargo discharge permission through NACCS, they need to conduct the Application for Cargo Discharge Permission(DNC).
