HISTORY ThefirstAmericanlawschoolswereestablishedover200 yearsago,althoughformuchofthe19thCenturymostlawyers wereself-educatedorstudiedunderthetutelageofpracticing lawyers.Notuntilwellintothe20thCenturyweremostAmerican lawyerseducatedinformallawschools. ProbablythemostsignificantdevelopmentinAmericanlegal educationwastheinstitutionofthecasemethodofinstructionat HarvardLawSchoolinthe187OsbyDeanChristopherColumbus Langdell.ThecasemethodwasbasedonLangdell'sviewthatthe academicdisciplineoflawshouldbeunderstoodasascience.For Langdell,thelawlibrarywasthelegalscientistslaboratoryand thecompilationsofstatutesandcasedecisionsweretherawdata tobestudied.Pursuanttothecasemethod,studentswouldbe presentedwiththerawdataofthecasesandaskedtodiscoverthe controllingprincipleswhichcouldthenbeusedtoadviseclients abouthowthelawwouldbeappliedinthefuture. Thistheoryreflectedthecommonlawsysteminwhichcourts resolvedisputesbasedontheprecedentofearliercases,and lawyersadvisedclientsbasedontheassumptionthatjudgeswould

Administrativelawwasvirtuallynon-existent. BeginningwiththeNewDealofPresidentFranklinRoosevelt, statutoryandadministrativelawtookonmoreimportanceinthe practiceoflaw,butlegaleducationcontinuedtobefocusedalmost exclusivelyonthecasemethod.Indeed,thecasemethodcontinues todominateAmericanlegaleducation,althoughallAmericanlaw studentsarenowexpectedtotakecoursesinstatutorylaw-Iike

taxationandcommerciallaw-andatleastabasiccoursein

administrativelawfocusingonthemultitudeofrulesissuedby federalandstategovernmentagencies.

Parallelwiththerelianceonthecasemethodhasbeena

relianceontheSocraticmethodofinstruction.Thecoreideaofthe Socraticmethodisthattheprofessorposesquestionsthatthe studentsanswerorallyduringclass.AnaccomplishedSocratic teacherwillhaveaseriesofquestionsinmindthataredesigned toleadthestudentstoanunderstandingofthebasicprinciplesin thecasesbeingstudied.Oftentheprofessorwillposequestions aboutthefacts,reasoningandhandingofaparticularcasethe studentshaveread,andwillthenposehypotheticalcasesinwhich thefactsaremodifiedandthestudentsareaskedtodetermine howtheruleofthefirstcaseshouldorshouldnotapplytothe hypotheticalcase. Generallytheprofessorwilleithercallonastudentwithout anyforewarningorwilltakevolunteers.Myexperiencehasbeen thatrelyingonvolunteersmeansthatmanystudentswillnot

theSocraticmethodistotrainstudentstothinkandspeak

spontaneously,itisgenerallythoughttobeimportantthatall studentsparticipateinclassdiscussions. CURRENTSTATE MostAmericanlawprofessorscontinuetorelyonthecase methodofinstructiontoasignificantdegree.However,othertypes ofmaterialshavegraduallybecomepartofwhatstudentsstudyin manyoftheircourses.ThisreflectstheevolutionofAmericanlaw overthepastcenturytoincludemanymorestatutesandavast arrayofregulatoryrules.Somesubjectscontinuetobeheavily dependentonthecommonlaw-e.g.torts,criminallaw,property, contracts-butothersubjectslikeenvironmentallaw,commercial law,taxation,healthlawandmanyothersderivelargelyfrom statutesandregulations. AsaconsecluencemanyAmericanlawprofessorshavebegun tousetheproblemmethodinadditiontothecasemethod.The problemmethod,firstusedwidelyinAmericabusinessschools, reliesonthestudyofrealorhypotheticalfactsituationsto understandhowthelawapplies.Oftentheprofessormayspend severalclasssessionsworkingthroughthecomplexitiesofa particularproblemwiththestudentsexpectedtofigureoutwhat thelawisandhowitapplies. Inadditiontostudyingcases,statutesandregulations, Americanlawstudentswilloftenbeaskedtoreadscholarly articlestoassistthemingaininganunderstandingofthelaw.

InvirtuallyeveryAmericanlawschool,thefirstyear

curriculumisrecluiredandfairlysimilar.Itnormallyincludes contracts,torts,property,civilprocedure,criminallawandlegal writingandresearch.Manyschoolsalsoincludeconstitutionallaw and/oradministrativelawasarequiredfirstyearclass.Afterthe firstyearmostclassesareelectives,althoughstudentsare generallyrecluiredtotakealegalethicsandprofessionalismclass. ThesubjectsstudiedinAmericanlawschoolshaveexpanded dramaticallyoverthelastfewdecades.AsAmericanlawpractice

hasbecomemoreandmorespecializedreflectingtheever-increasingcomplexityofthelaw,specializedcoursesinawide arrayoftopicshavebeendeveloped.Examplesofsuchclasses mightinclude:healthlaw,aviationlaw,oceanlaw,wildlifelaw, animallaw,waterlaw,Ianduselaw,sportslaw,entertainmentlaw, patentlaw,admiraltylaw,internationalbusinesstransactions, copyrightlaw,cyberlaw,andsoforth. Mostlawstudentstakeasetofcoreupperdivisioncourses thattheyexpecttofaceonthebarexamination.Inadditiontothe firstyearrequiredcoursesthesewillgenerallyincludecorporations orbusinessassociations,commerciallaw,fcderaltaxation,evidence, willsandtrustsandothersubjectsdependinguponthestatein whichtheyplantotakethebarexamination. Overthelastthreedecades,Americanlawschoolshavebegun

generallyencouragedtogetagoodbroadandgenerallegal

educationsothattheyarepreparedtopursuemostkindsofwork theymightencounteraftergraduation.Theonefieldwhere advancedtrainingbeyondtheJDdegreeisthenormistaxation. EveryAmericanlawstudentstudieslegalresearchandwriting duringtheirfirstyearoflawschool.Theobjectiveistoteachthe studentshowtoconductlegalresearch,whichincreasinglyisdone throughelectronicdatabases-ratherthanbooks,andtointroduce themtotheformsandcontentoflegalwriting.Mostlawschools alsore(luirestudentstocompleteoneortwomajorwriting projectswhileinlawschool.IwouldsaythatmostAmericanlegal educatorsagreethatwritingisthemostimportantskillfornew lawyerstomaster. Clinicallegaleducationhasalsoexpandedsignificantlyover thelastfourdecades.Inlawclinics,studentshavetheopportunity toworkonrealcaseswithfacultymemberswhoarethemselves practicinglawyers.Usuallythecasestheyworkonarefairly simple,butgenerallythestudentisabletohandlethecasefrom starttofinishincludingmakingappearancesincourtorbefore administrativebodies.Veryrecentlyschoolshavealsodeveloped

clinicsinwhichstudentsworkonwhatwewouldcall

transactionalpracticeskills.Thesestudentsassistclientswiththe negotiationofprivateagreementsandthedraftingofbasiclegal documents-theofficepracticethatisinfactwhatmostAmerican

AlthoughmostAmericanlawyersdonotappearfrequentlyin court,allofourstudentsareexpectedtoparticipateinamoot courtofsometype.Usuallythisisanappellateproceedingin whichthestudentisrecluiredtowritealegalbriefandthenargue beforeapanelofjudges.Studentsalsohavetheopportunityto studytrialpracticetechniquesandtopracticethosetechnicluesin amocktrialproceeding.Therearenumerouscompetitionsthat allowlawstudentsfromoneschooltocompeteagainststudents fromotherschoolsinthesemootcourtsandmocktrials.Generally thejudgesinthesecompetitionsarerealjudgesfromthestateand federalcourts. Thestandardlawschoolprogramtakesthreeyearsorsix semestersofstudy.Thismeansthatfulltimelawstudentswill devotemostoftheirtimetotheirstudiesbetweenlateAugustand May.Duringthesummerstheywillgenerallyfindlegalworkof sometyl)ewhichisbothusefultotheireducationandgivesthem anopportunitytoexperiencedifferenttypesoflegalwork.Most fulltimelawstudentswillalsoworkafewhoursaweek,often withalawfirm,judgeorgovernmentagency.Mylawschoolalso

hasapart-timeprogramthatrecluiresastudenttotakea

somewhatlightercourseloadeachsemesterandfinishlawschool infouryears.Bothfulltimeandpart-timestudentscangraduate more(luicklyiftheyattendsummerschool. FACULTY Americanlawfacultymembersarealllawyers,manywith

Thenormalcareerpathforalawfacultymemberinthe

UnitedStateslookssomethinglikethis.Theywillhavegraduated fromlawschoolandoftengoneontobeaclerkforajudgeinthe federalorstatecourtsystems.Afterayearortwoofclerkingfor ajudge,theywillenterintolawpracticeeitherwithalawfirmor withagovernmentagency.Afterthreeorfouryearsofpractice, theywillseekalawteachingjob.Manywillhavewrittenlaw reviewarticlesbeforejoiningafaculty. Unlesstheyarehiredafterteachingatanotherlawschool, facultywillstartasassistantprofessors.Afterthreeorfouryears theywillbepromotedtoassociateprofessoriftheyhavebeen successfulteachersandproductivescholars.Theywillalsobe expectedtocontributetothecommunityandprofession.Twoor threeyearsafterpromotiontoassociateprofessortheywillbe consideredfortenure.Oncetenuredtheycannotbeterminated exceptforseriouscauseorduetofinancialexigencyofthe institution.Twoorthreeyearsafterbeingtenured,theywillbe promotedtofullprofessor,againassumingtheyhavemetthe recluirements. Atmylawschoolsuccessfulteachingisveryimportant.We usestudentevaluationstoassessteachingclualityandwealso visittheclassesofthoseupforpromotionortenure.Wealsoask facultymembersfromotherlawschoolstoreviewthescholarship ofourfacultypriortopromotionortenure.

engagedinaseriousresearchproject.Theyareeligiblefora sabbaticalleaveonceeverysevenyears.Oftentheseleaveswill involveforeignstudyandmaypresentopportunitiesforour facultytovisithereinJapan. RELATIONTOUNIVERS]TY

Most,butnotall,Americanlawschoolsareapartofa

university,orlargerinstitution.Thisassociationoftencreates opportunitiesoflawfacultyandstudentstoworkwithpeoplein otherdisciplines.Themostcommoncollaborationshavebeenwith economicsandothersocialsciences,butincreasinglythereis collaborativeresearchandsometimesjointlytaughtclassesinthe variousphysicalandbiologicalsciences. Itisalsocommonforlawschoolsandbusinessschoolsto cooperateandsometimestoofferjointdegreeprograms.Atmy schoolourfacultyhastakenaparticularinterestinintroducingour businesslawstudentstobasicconceptsofbusinesssothatthey haveabetterunderstandingoftheneedsandinterestsoftheir businessclientswhentheyenterthepracticeoflaw. REGULAT]ON AmericanlegaleducationisregulatedbytheAmericanBar Association(thenationalprofessionalassociationofAmerican

lawyers).Theauthorit•yoftheABAtoregulatelawschoolsderives

fromthefactthatlawyersineachstatemustbelicensedbythe

AMERICANLEGALEDUCATION:PAST,PRESENTANDFUTURE(JarnesL.Hutfman)(9)290 SupremeCourtofthatstate.Everystate,exceptCalifornia,recluires thatlawyersmustgraduatefromanABAaccreditedlawschoolto beeligibleforadmissiontothepracticeoflaw.Thus,thevast majorityoflawschoolsseekaccreditationbytheABAsothat theirgraduatesmaypracticeanywhereintheUnitedStates. TheABAcollectsinformationannuallyfromeachlawschool andconductsanaccreditationreviewincludingasitevisitonce everysevenyears.ToqualifyforABAaccreditationalawschool tnustmeetminimumstandardsforfacultyqualificationsand support,curriculum,facilities,Iibraryresources,studentsservices andpreparationofgraduatesforreasonablesuccessonthebar examination.

MostAmericanlawschoolsarealsomembersofthe

AssociationofAmericanLawSchools.Membersmustmeet

minimumstandardslargelyfocusedonacademicachievementby facultyandstudents. FUNDING-PUBLICANDPRIVATE Americanlawschoolsareroughlyevenlydividedbetween publicandprivate.Publiclawschoolsarepartofstatesupported universitysystems.Historicallytheyderivedmostoftheirfinancial supportfromthestatelegislature.Overthelasttwodecadesmost stateshavecutbackontheirfinancialsupportofhighereducation withtheresultthatstudenttuitionandfeesatpubliclawschools haverisendramatically.Assomepubliclawschools,statesupport provideslessthan2O%ofthetotalcostofoperations. Privatelawschoolsaregenerallypartofaprivateuniversity,

28g(Io)~I~"~~~;~~~~12~~I~~(~:~~;~~25~~)(2005) althoughthereareseveralthatarefreestandingwiththeirown governingboard.Mylawschoolispartofalargerinstitutionthat alsoincludesanundergraduatecollegeandagraduateschoolof educationandcounseling.Privatelawschoolsderivemostoftheir incomefromtuition.Asaresulttuitionatprivatelawschools tendstobemuchhigherthanatpubliclawschools,oftentwoor threetimesasmuch.Atmylawschool,annualtuitionisabout $25,000. Historically,privatelawschoolshavealsodependedon donatedfundsfromalumniandothers.Duetothereductionin statesupport,publiclawschoolshavealsobecomeincreasingly

dependentonprivatefundraising.Atmylawschool,

approximately2O%ofourgraduatescontributeeachyeartothe lawschool'sannualfundraisingcampaign. Veryfewlawstudentsareabletoaffordtheannualtuition withoutborrowingmoney.Mostareabletoobtainfederally subsidizedloanswhicharegenerallypaidoffduringthetenyears aftergraduation.Theaveragelawschooldebtforourgraduatesis about$70,000.Thisisnotdifficulttopayforgraduateswhotake jobsinprivatelawfirmsorwithbusiness,butforthosewhohave jobswithpublicinterestorganizationsorwithlegalaidofficesit canbeaseriousproblem. Inmyopinion,Americanlegaleducationhasbenefitedfrom themixofprivateandpublicschools.Ithascreatedacompetitive marketforlegaleducationwithawidevarietyofschoolstomeet almostanystudent'sneeds.Detailedinformationabouteverylaw

schoolintheUnitedStatesisreportedbytheAmericanBar

ADMISSIONS Atmostlawschools,thefacultyplaysanimportantroleinthe admissionsprocess.Atmyschool,wehaveanadmissionsstaff thatcompilesandinitiallyreviewapplications.Afacultycommittee thanreviewsthosewhomightclualifyforadmissiontoselectthe best.Becausewegetapplicationsfrommanymorepeoplethanwe canadmit,wemustdenyadmissiontomanyqualifiedapplicants. Forthisyear'senteringclassof230,wehadover2500applications. However,becausemostapplicantswillapplytoseverallaw schools,weofferedadmissiontoabout9OOinordertogetaclass

of23O.Aboutonequarterofourstudentscomefromourhome

stateofOregon,whiletheremaindercomefromalmostevery otherstateinthecountryaswellasafewfromforeigncountries. LawschoolapplicantsarerequiredtotaketheLawSchool AdmissionTest(LSAT)beforemakingapplication.Theirscoreon thistestissubmittedtoeachlawschooltheywishtoapplyto alongwiththeirgradesandtranscriptfromtheirundergraduate

universityandanygraduatedegreestheymayhaveearned.

Applicantsarealsorequiredtowriteastatementaboutwhythey areinterestedinattendinglawschoolandsubmitlettersof referencefrompeoplewhocanattesttotheirlikelysuccessinlaw school.Theirpersonalstatementsarealsousefulasanindicatorof theirabilitytowriteclearlyandconcisely. Asyouprobablyknow,allAmericanlawstudentsmustfirst

Asaresult,themajorityoflawstudentsareintheirmidandeven latetwentiesintermsofage. STUDENTLIFE Becausemostlawschoolsarepartofalargeruniversity,there aregenerallymanyopportunitiesforstudentstobeinvolvedin extracurricularactivities.Evenwithoutalargeruniversity,most

lawschoolshavenumerousstudentgroupsfocusedonawide

varietyofinterests,bothlegalandnonlegal.Thestudentsatmy lawschoolareveryactiveinthecommunityandactivelyinvolved

inthegovernanceofthelawschool.Wehavetwostudentson

everyfacultycommittee,exceptpromotionandtenure,andhave votingstudentrepresentativesatourfacultymeetings.Ourviewis thatwecanbetterprovidefortheneedsandinterestsofour studentsiftheyareactiveparticipantsintheschool.

BAREXAM

EveryAmericanjurisdiction(thefiftystates)recluiresthat lawyerspassabarexaminationbeforebeingadmittedtopractice. Formanyyearsthismeantthatlawyerswouldhavetotakeabar examinationineachstatewheretheysoughttopractice.Thisis stillthecasetosomeextent,althoughmoreandmorestatesare enteringintoreciprocalagreementstoacceptthebarexamination resultsoftheotherstate.Eachstatedesignsandadministersits ownbarexamination,sotheyvarysignificantlyfromstateto

Thereisamultistatebarexaminationthatstatescanchoose touseiftheylike.Moststat!esdousethemultistateexamwhich isasixhourmultiplechoiceexamcoveringproperty,contracts, torts,evidence,constitutionallawandcriminallaw.Inaddition, moststateswillhaveaseconddayofquestionstowhichessay answersarerequired.Thesequestionscanbeonanysubject withinthelistofpotentialsubjectsspecifiedbythestate.Students willnotbetestedonallsubjects,buttheymustprepareforall subjectsbecausetheydohotknowwhichoneswillbecoveredon theexamination.Theessayquestionsaregenerallywrittenand

gradedbyaboardofbarexaminerswhoareusuallyyoung

lawyerswhovolunteerforthetask.Itcantakeanywherefrom

twotosixmonthsfortheexamstobegraded.Thepassrate

variesfromaslowas60%insomestatestoashighas95%in

others.Ofcoursethepassratealsovariesfromyeartoyearin anygivenstate. Studentsprepareforthebarexaminationintwobasicways. Theirlegaleducationisobviouslyimportant,butAmericanlaw

schoolsdonotteachtotheexam.(Bythis,Imeanwedonot

designourlawschoolclassesorcurriculumaroundthespecificsof thebarexamination,inpartbecauseourstudentswilltakethe examinationinmanychfferentstatesandinpartbecausewe

believewehaveanimportantacademicmissionbeyondthe

preparationofstudentsforthebarexamination.)However,most facultymembersassurethattheircoursesgivefullcoveragetothe subjectandasalawschoolweoffereverysubjectthatmightbe onabarexamination.Studentsalsolearnthetechniqueoftaking essayexamssincemostlawschoolexaminationsareoftheessay type.

Thesecondwayinwhichstudentsprepareforthebar

examinationisbytakingabarreviewcourseaftergraduation. Thisisasixweekintensivecoursethatreviewsindetailevery subjectonthebarexamination.Thecourseisnotofferedbyany lawschools,althoughitisoftentaughtonlawschoolcampuses fortheconvenienceofthestudents.Thecoursesareofferedby

privatecompaniesthatspecializeinthestudyofpastbar

examinationsandarethuswellabletoeducatestudentsabout whattheycanexpectonthebarexamination. Studentswhodonotpassthebarexamareeligibletotakeit again.Mostwillpasstheexamonthesecondorthirdtry,although thereisasmallpercentagethatneverpassandaretherefore precludedfrompracticinglaw. PLACEMENT A11Americanlawschoolsactivelyassisttheirstudentsin findinglegalemploymentaftergraduation.Thisisdonebyinviting legalemployerstocampusforinterviewswithstudentsandby assistingstudentsinthepreparationoftheirapplicationmaterials andinidentifyingemploymentopportunities.

AMERICANLEGALEDUCATION:PAST,PRESENTANDFUTURE(JamesL,Huffman)(15)284 Lawstudentsenterintomanydifferentkindsofwork.Some gotoworkforlargelawfirmswheretheywilltendtospecialize inanarrowareaofpractice.Othersjoinsmallfirmsthatmayhave specializedpracticesormayoffergenerallegalservices.Stillothers willfindjobswithgovernmentagencies,publicinterestgroups,in houselegalcounselpositionswithbusinessorlegalaid,which provideslegalservicestothepoor.Afewlawgraduateswillnot practicelaw,butwillpursuebusinessorothertypesofwork. CHALLENCES ThebiggestchallengesforAmericanlegaleducationlookingto

thefutureistokeeppacewiththelegalneedsofarapidly

globalizingeconomy.Ours,Iikeeveryother,isaninsularlegal systemthathasstruggledtoadapttoaworldinwhichnational

boundariesarelessandlessimportantfromaneconomic

perspective.Indeed,theInternethasledtoaworldinwhich nationalgovernmentsareoftenincapableofexercisingcontrol.Our challengeistotrainournewlawyerstofunctioninthisworldand tounderstandthepeoplesandculturestheywilldealwithinthe future.Wewillalsoneedtodesigninstitutionsthatareresponsive

totheneedsanddemandsofaglobaleconomyandsociety.

Althoughwehavejustbegunthiscollaborationbetweenourtwo schools,Ithinkwearetakinganimportantandnecessarystepin facingthischallenge. DeanandErskineWoodSr.ProfessorofLaw
